We have never written a declaration of conformity
An EU declaration of conformity is the manufacturer's signed statement that a product meets the act's requirements. It is drawn up only after the conformity assessment, follows the model structure in the act's annex, names the acts and standards applied, and is kept up to date and translated where required. Under the low voltage, radio and toy directives the manufacturer keeps it for 10 years.

Why this happens
The EU declaration of conformity is a short document with a heavy meaning. Under the Low Voltage Directive 2014/35/EU it states that the fulfilment of the safety objectives in Annex I has been demonstrated (Article 15(1)). It follows the model structure in Annex IV, contains the elements of Module A in Annex III, is continuously updated and is translated into the languages the Member State of sale requires (Article 15(2)). By drawing it up, the manufacturer assumes responsibility for the compliance of the equipment (Article 15(4)). The manufacturer writes it only after the conformity assessment has demonstrated compliance, affixes the CE marking at the same stage, and keeps the declaration with the technical documentation for 10 years (Article 6(2) and (3)).[1]
The model is almost the same across the acts. Annex IV of the Low Voltage Directive asks for the product model, type, batch or serial number; the name and address of the manufacturer or its authorised representative; the statement that the declaration is issued under the sole responsibility of the manufacturer; the object of the declaration, which may include a colour image; the statement of conformity with the relevant Union harmonisation legislation; the references of the harmonised standards or other technical specifications; additional information; and the signature block with place, date, name and function. The EMC Directive 2014/30/EU adds the date of each standard and, where applicable, the notified body's intervention (Annex IV).[1][3]
Radio equipment has two extra points. Annex VI of Directive 2014/53/EU asks for standards with their identification number and version and, where applicable, date of issue, and, where applicable, a description of the accessories and components, including software, covered by the declaration. Each item must be accompanied by a copy of the declaration or by the simplified declaration of Annex VII, which gives the exact internet address of the full text (Articles 10(9) and 18(2)).[2]
Toys use the older name, the EC declaration of conformity. It states that Article 10 and Annex II are met, follows the model in Annex III to Directive 2009/48/EC, contains the elements of the relevant modules in Decision No 768/2008/EC and is continuously updated (Article 15). Those modules come from the common framework: Article R10 of Decision No 768/2008/EC sets the same pattern of model structure, updating and translation, and Annex III of the decision holds the original model. The Toy Safety Regulation (EU) 2025/2509, which applies from 1 August 2030, replaces the toy declaration with a digital product passport that the manufacturer creates before placing the toy on the market; by creating it, the manufacturer assumes responsibility for the toy's compliance (Article 19(1) and (4)).[5][6][7]
A declaration that is missing, incomplete or out of date is a non-compliance that the authority can order corrected. Where the operator does not act, the authority ensures that the product is withdrawn, recalled or prohibited (Regulation (EU) 2019/1020 Article 16(3) and (5)).[4]
How to solve it
-
Finish the conformity assessment first
The declaration records a result. Under each act it is drawn up only where compliance has been demonstrated by the conformity assessment procedure, so the technical documentation, the test reports and any notified body certificate must exist before you write it.
-
List the acts and the standards with their versions
Name every Union act that requires a declaration for the product, with its publication reference. List the harmonised standards or other technical specifications applied. The EMC model asks for the date of each standard; the radio model asks for the identification number and version and, where applicable, the date of issue.

Fill in the model structure from the act's annex
Use the annex of the act: Annex IV for low voltage and EMC, Annex VI for radio equipment, Annex III for toys. The common items are a number, the product model and type or batch, the manufacturer's or authorised representative's name and address, a sole-responsibility statement, the object of the declaration and the conformity statement.

Sign and date it for the manufacturer
The model ends with signed for and on behalf of, place and date of issue, and the name, function and signature of the signatory. By drawing up the declaration the manufacturer assumes responsibility for the product's compliance.
-
Translate it, supply it and keep it current
Translate it into the languages the Member State of sale requires. For radio equipment, ship each item with a copy or with a simplified declaration giving the web address of the full text. Update the declaration whenever the product, the standards or the acts change, and keep it for 10 years.

If you do nothing
The manufacturer carries the responsibility
By drawing up the EU declaration of conformity, the manufacturer assumes responsibility for the compliance of the product with the requirements of the directive (Directive 2014/35/EU Article 15(4); Directive 2014/53/EU Article 18(4)).[1]
Radio products shipped without the declaration
Manufacturers must ensure that each item of radio equipment is accompanied by a copy of the EU declaration of conformity or by a simplified declaration with the exact internet address of the full text (Directive 2014/53/EU Article 10(9)).[2]
A missing or wrong declaration is a non-compliance
Authorities require the operator to bring the product into compliance, including rectifying formal non-compliance, and where that does not happen they ensure withdrawal, recall or a prohibition (Regulation (EU) 2019/1020 Article 16(3)(a) and (5)).[4]
Questions about this problem
Who should sign the declaration?
The model ends with signed for and on behalf of, followed by the place and date of issue and the name, function and signature of the signatory (Directive 2014/35/EU Annex IV). It is issued under the sole responsibility of the manufacturer (item 3). An authorised representative may draw it up on the manufacturer's behalf and under its responsibility if the mandate says so (Annex III, Module A point 5).
Can we use our supplier's declaration?
Only if the supplier is the manufacturer of the product as you place it on the market. The declaration is issued under the sole responsibility of the manufacturer (Directive 2014/35/EU Annex IV item 3), so a business selling under its own name or trade mark issues its own.
Which language does it have to be in?
It is translated into the language or languages required by the Member State in which the product is placed or made available on the market (Directive 2014/35/EU Article 15(2); Directive 2014/30/EU Article 15(2); Directive 2014/53/EU Article 18(2)).
Is a toy declaration different?
Under Directive 2009/48/EC the EC declaration of conformity states that Article 10 and Annex II are met, follows the model in Annex III to the directive, contains the elements of the relevant modules in Decision No 768/2008/EC and is continuously updated (Article 15). Under Regulation (EU) 2025/2509, from 1 August 2030, a digital product passport replaces the declaration for toys (Article 19).
Does the declaration need updating after it is signed?
Yes. The low voltage, EMC and radio directives all require the declaration to be continuously updated (Directive 2014/35/EU Article 15(2); Directive 2014/30/EU Article 15(2); Directive 2014/53/EU Article 18(2)).
