Our supplier recalled a product we sell
When the manufacturer or importer recalls a product, a distributor is part of the corrective measure. Under the General Product Safety Regulation (EU) 2023/988, a distributor who has reason to believe that a product it made available is dangerous must ensure that corrective measures are taken, including withdrawal or recall, and that the authorities are informed. Stop selling, notify identifiable customers, and give the manufacturer your sales data.

Why this happens
A recall started by your supplier is not the supplier's problem alone. The General Product Safety Regulation (EU) 2023/988 gives distributors their own duties for the products they make available. A distributor who has reason to believe that a product is not in conformity may not make it available until it has been (Article 12(3)). A distributor who has reason to believe that a product it has already made available is dangerous must immediately inform the manufacturer or importer, ensure that the corrective measures are taken, including withdrawal or recall, and ensure that the market surveillance authorities of the Member States concerned are immediately informed through the Safety Business Gateway, giving the details it has on the risk, the number of products involved and any measure already taken (Article 12(4)).[1]
Reaching the buyers is a shared duty. In a product safety recall, economic operators, in accordance with their respective obligations under Articles 9 to 12, ensure that all affected consumers who can be identified are notified directly and without undue delay, and operators that collect customer data must use it for that purpose (Article 35(1)). Where not everyone can be reached, the recall notice goes out through the channels with the widest reach, including the company's website, social media, newsletters and retail outlets (Article 35(4)). The notice itself follows Article 36 and is written by the operator responsible for the recall.[1]
Marketplaces have a parallel duty: to notify the consumers who bought the product through their interfaces, to publish recall information, to inform the operator when they remove an offer, and to cooperate so that recalls are effective (Article 22(12)). The remedy comes from the operator responsible for the recall, which must offer the consumer an effective, cost-free and timely remedy (Article 37(1)).[1]
The Commission's guidance to businesses adds the practical point: consumers return products when the recall is simple and the remedy is speedy, so the supplier's notice, the remedy and the return route should be the same wherever the consumer hears about it.[3]
Where an operator in the chain fails to act, market surveillance authorities ensure the withdrawal or recall themselves under Regulation (EU) 2019/1020 (Article 16(5)).[2]
How to solve it
-
Stop making the product available
A distributor may not make available a product it has reason to believe is dangerous until it has been brought into conformity. Pull the affected batches from the shelf, the warehouse and the webshop the day you learn of the recall, and identify the units by the batch or serial numbers in the recall.
-
Confirm who runs the recall and what it covers
The economic operator responsible for the recall offers the consumer the remedy. Ask the manufacturer or importer for the exact product identification, the recall notice, the remedy consumers get, and how returns are handled, so that your customers hear one consistent message.
-
Notify the buyers you can identify
All affected consumers who can be identified must be notified directly and without undue delay, and the customer data you collect must be used for that purpose. Go through orders, loyalty programmes and warranty registrations for the batches concerned and send the recall notice to each buyer.

Publish the notice in your own channels
Where not all consumers can be reached directly, the recall notice is spread through other channels with the widest possible reach: your website, social media, newsletters and retail outlets. Use the manufacturer's notice as it is; do not soften it.
-
Give the manufacturer your numbers and keep the record
The distributor gives the details it has on the risk, the number of products involved and any corrective measure already taken. Record how many units you sold, how many buyers you notified and how many came back, and keep the traceability data on where the units came from and went.

What you need to show
| Document | Where it comes from | Legal ground |
|---|---|---|
| The recall notice received from the manufacturer or importer | The economic operator responsible for the recall | GPSR Article 36 |
| Your direct notifications to identified buyers | Your order, loyalty and registration data | GPSR Article 35(1) |
| Sales and traceability records for the affected batches | Your purchase and sales systems | GPSR Articles 12(4) and 15(3) |
| Your own notification, where you made one | The Safety Business Gateway | GPSR Article 12(4)(c) |
If you do nothing
The authority acts against you as well
Where an operator fails to take corrective action, the authority ensures the product is withdrawn or recalled or that its being made available is prohibited or restricted (Regulation (EU) 2019/1020, Article 16(5)).[2]
Your marketplace account is at risk
Marketplaces suspend, after a prior warning and for a reasonable period, traders that frequently offer non-compliant products (GPSR Article 22(11)), and they cooperate with authorities and operators to ensure effective recalls (Article 22(12)).[1]
Penalties under national law
Each Member State lays down effective, proportionate and dissuasive penalties for infringements of the regulation (GPSR Article 44).[1]
Questions about this problem
The manufacturer has already notified the authorities. Must we notify too?
The distributor's duty is to ensure that the authorities of the Member States where the product was made available are informed through the Safety Business Gateway (GPSR Article 12(4)(c)). Where the manufacturer or importer has done that for the product and markets you sold in, the notification exists; confirm it in writing and keep the confirmation. If you cannot confirm it, make the notification yourself.
Who pays the refund or the replacement?
The economic operator responsible for the recall offers the consumer an effective, cost-free and timely remedy (GPSR Article 37(1)). How the costs are shared between you and your supplier is set by your contract.
Can we sell the remaining stock once the supplier has fixed it?
Not before the product has been brought into conformity (GPSR Article 12(3)). Ask the supplier which units are affected and what evidence shows the fix.
We sell through a marketplace. Does it notify our buyers?
Marketplaces must directly notify all affected consumers who bought the product through their interfaces once they have actual knowledge of the recall, and publish recall information on their interfaces (GPSR Article 22(12)(a)). Tell the marketplace as soon as you know.
