We cannot reach the customers who bought the product
The General Product Safety Regulation (EU) 2023/988 requires that all affected consumers who can be identified are notified directly and without undue delay, using the customer data you hold (Article 35(1)). Marketplaces must notify the buyers who bought through them (Article 22(12)). Where not everyone can be reached, you spread a clear and visible recall notice through your website, social media, newsletters, retail outlets and, where appropriate, mass media.

Why this happens
The General Product Safety Regulation (EU) 2023/988 turns reaching the buyers into a duty with an order of priority. In a product safety recall, or where a safety warning has to reach consumers, economic operators, each according to its obligations under Articles 9 to 12, and providers of online marketplaces under Article 22(12), ensure that all affected consumers who can be identified are notified directly and without undue delay. Operators and marketplaces that collect their customers' personal data must use that information for recalls and safety warnings (Article 35(1)).[1]
Registration data is handled with care but is meant to be used. Where an operator runs a product registration system or a loyalty programme for other purposes, it must offer customers the possibility to give separate contact details for safety purposes only; those data are limited to the minimum and used only to contact consumers in a recall or safety warning (Article 35(2)). The Commission may, by implementing act, require registration possibilities for specific product categories (Article 35(3)).[1]
Only where not all affected consumers can be contacted directly does the public notice take over. Then operators and marketplaces, according to their responsibilities, disseminate a clear and visible recall notice or safety warning through other appropriate channels, ensuring the widest possible reach: the company's website, social media channels, newsletters and retail outlets, and, as appropriate, announcements in mass media and other channels, accessible to persons with disabilities (Article 35(4)). The written notice follows Article 36.[1]
Marketplaces carry the buyers you cannot see. They must directly notify all affected consumers who bought the relevant product through their interfaces once they have actual knowledge of a recall, publish recall information on their interfaces, inform the operator when they remove an offer, and cooperate with authorities and operators to ensure effective recalls, including by not obstructing them (Article 22(12)). Distributors, for their part, ensure the corrective measures are taken and give the details they have on the risk and the number of products involved (Article 12(4)).[1]
The Commission's advice to businesses is to encourage customers to register their purchases and to explain that the data will only be used to contact them if a problem occurs. Where the response stays low, market surveillance authorities can require further corrective action, including alerting the public, and ensure the recall themselves where the operator fails to act (Regulation (EU) 2019/1020, Article 16(3) and (5)).[3][2]
How to solve it
-
List every source of buyer data you hold
Webshop orders, warranty and product registrations, loyalty programmes, customer service tickets, and the contact details consumers gave for safety purposes. The regulation requires operators that collect customer data to use it for recalls and safety warnings, so the question is not whether you may, but where it is.
-
Ask distributors and marketplaces to notify their buyers
Distributors have their own duty to ensure the corrective measures are taken and to notify the consumers they can identify. Marketplaces must directly notify all consumers who bought the product through their interfaces once they know of the recall, publish recall information, and cooperate to make the recall effective. Send each of them the batch numbers, the notice and the remedy, and ask for their counts.

Go wide where the data ends
For the consumers nobody can identify, disseminate a clear and visible recall notice through the channels with the widest reach: the company website, social media channels, newsletters and retail outlets, and, as appropriate, announcements in mass media. Make it accessible to persons with disabilities.
-
Measure the response and repeat
Count the units sold, the buyers notified and the units returned per channel and per country. Authorities may ask for regular progress reports and decide when the corrective measure counts as completed, so a low response is a reason to repeat the notice, not to close the case.
-
Set up registration for next time
Offer consumers a way to register the product, or to give separate contact details used only for safety purposes, and keep those data to the minimum. Manufacturers must in any case make public communication channels for complaints and safety issues available, and importers check that they exist.

If you do nothing
The authority alerts the public in your place
Market surveillance authorities can require the operator to recall the product and alert the public, or, where the risk exists only in certain conditions or for certain end users, to alert the end users at risk; where the operator fails to act, they ensure the recall and inform the public themselves (Regulation (EU) 2019/1020, Article 16(3)(c) and (g), 16(4) and 16(5)).[2]
The recall does not close
Authorities may request regular progress reports and decide whether or when the corrective measure can be considered completed (GPSR Article 15(6)).[1]
Penalties under national law
Each Member State lays down effective, proportionate and dissuasive penalties for infringements of the regulation (GPSR Article 44).[1]
Questions about this problem
May we use loyalty programme data to contact buyers?
The regulation requires it: operators that collect their customers' personal data must use that information for recalls and safety warnings (GPSR Article 35(1)). Data collected only for safety purposes must be limited to the minimum and used only for a recall or safety warning (Article 35(2)).
Do marketplaces have to help?
Yes. They must directly notify all affected consumers who bought the product through their interfaces once they have actual knowledge of the recall, publish recall information on their interfaces, and cooperate with authorities and operators to ensure effective recalls (GPSR Article 22(12)).
Is a notice on our website enough?
No. Consumers who can be identified are notified directly first. The website, social media, newsletters and retail outlets are the channels for those who cannot be reached directly (GPSR Article 35(1) and (4)).
Do we have to advertise in newspapers or on television?
The regulation names announcements in mass media 'as appropriate' among the channels for the widest possible reach (GPSR Article 35(4)). Whether they are appropriate depends on how many buyers remain unreached and how serious the risk is.
