We do not know which remedy we must offer in a recall
GPSR Article 37 (Regulation (EU) 2023/988) requires the operator responsible for a recall to offer an effective, cost-free and timely remedy, as a rule a choice of at least two of repair, replacement and a refund of at least the price paid. A single remedy is allowed only where the others are impossible or disproportionate. Consumers never pay shipping and get a refund when repair or replacement takes too long.

Why this happens
Before the General Product Safety Regulation (EU) 2023/988, what a consumer received in a recall depended on the company. Since 13 December 2024, Article 37 sets a floor. In the case of a product safety recall, whether initiated by an economic operator or ordered by a national authority, the economic operator responsible for the recall must offer the consumer an effective, cost-free and timely remedy (Article 37(1)). The article applies without prejudice to Directives (EU) 2019/770 and (EU) 2019/771, so the consumer's rights under the legal guarantee stay where they are.[1]
The core rule is a choice. Without prejudice to other remedies the operator may offer, the consumer chooses between at least two of: repair of the recalled product; replacement with a safe one of the same type and at least the same value and quality; or an adequate refund of the value of the recalled product, at least equal to the price paid (Article 37(2)). Offering only one remedy is an exception, allowed where the others would be impossible or would impose disproportionate costs on the operator, taking all circumstances into account, including whether the alternative could be provided without significant inconvenience to the consumer. Whatever is offered, the consumer is always entitled to a refund when repair or replacement is not completed within a reasonable time and without significant inconvenience.[1]
The article also closes the usual escape routes. Repair by the consumer counts as an effective remedy only where it can be carried out easily and safely and is envisaged in the recall notice, and the operator then supplies the instructions, free replacement parts or software updates (Article 37(3)). Disposal by the consumer may only be asked for where it is easy and safe, and does not affect the right to a refund or replacement (Article 37(4)). The consumer never bears the cost of shipping or returning the product, and products that are not portable by nature are collected (Article 37(5)).[1]
The remedy is tied to the rest of the recall. The recall notice must contain a clear description of the remedies available under Article 37 (Article 36(2)(e)), so the remedy decision comes before the notice is written. Authorities may ask for regular progress reports and decide whether or when the corrective measure can be considered completed (Article 15(6)), and where an operator's action is inadequate they can order the recall themselves (Regulation (EU) 2019/1020, Article 16(3) and 16(5), applied by GPSR Article 23(1)).[1][2]
How to solve it
-
Check which of the three remedies you can deliver
For each recalled product, check whether a repair that removes the hazard exists, whether a safe replacement of the same type and at least the same value and quality is available, and what an adequate refund would be. The refund must be at least the price the consumer paid.
-
Offer at least two, or document why only one
The consumer chooses between at least two remedies. Offering only one is allowed by way of exception, where the other remedies would be impossible or would impose disproportionate costs, taking into account whether the alternative could be provided without significant inconvenience to the consumer. Write down that reasoning, so you can give it when an authority asks for the necessary information (GPSR Article 15(2)).
-
Take the costs and the effort off the consumer
The remedy must be cost-free and must not entail significant inconvenience. The consumer does not pay shipping or other return costs. For products that are not portable by nature, arrange collection. Consumer repair counts only where it is easy and safe and the recall notice provides for it, with instructions, free parts or software updates.
-
Set a deadline you can keep, with a refund behind it
Plan capacity for repairs and replacements. If they are not completed within a reasonable time and without significant inconvenience, the consumer is always entitled to a refund, so budget for that outcome too.
-
Describe the remedies in the notice and track every case
The recall notice must contain a clear description of the remedies available. Record per consumer which remedy was chosen, when it was delivered and what it cost, so you can report progress to the authority.

What you need to show
| Document | Where it comes from | Legal ground |
|---|---|---|
| The remedy decision, with the reasons for any single-remedy exception | The economic operator responsible for the recall | GPSR Article 37(2) (the article sets no written form; recording the reasons is good practice) |
| The recall notice describing the remedies | The economic operator responsible for the recall | GPSR Article 36(2)(e) |
| Instructions, free parts or software updates for consumer repair | The economic operator responsible for the recall | GPSR Article 37(3) |
| A record of remedies delivered per consumer | The economic operator responsible for the recall | GPSR Article 15(6) (progress reports on request; the per-consumer record itself is good practice) |
If you do nothing
The consumer can insist on a refund
The consumer is always entitled to a refund when the operator has not completed the repair or replacement within a reasonable time and without significant inconvenience (GPSR Article 37(2), third subparagraph).[1]
The authority decides when the recall is done
Market surveillance authorities may request regular progress reports and decide whether or when the corrective measure can be considered completed (GPSR Article 15(6)).[1]
Collective action by consumers
Directive (EU) 2020/1828 applies to representative actions against infringements of the GPSR that harm, or may harm, the collective interests of consumers (GPSR Article 39).[1]
Penalties under national law
Each Member State lays down effective, proportionate and dissuasive penalties for infringements of the regulation (GPSR Article 44).[1]
Questions about this problem
Can we offer a voucher instead of a refund?
Article 37(2) names a refund of the value of the recalled product of at least the price paid. You may offer other remedies on top, but they do not replace the choice between at least two of repair, replacement and refund.
May we offer only a refund?
Only by way of exception, where repair and replacement would be impossible or would impose disproportionate costs compared with the refund, taking all circumstances into account (GPSR Article 37(2), second subparagraph).
Who pays to send the product back?
Not the consumer. The consumer does not bear the costs of shipping or otherwise returning the product, and for products that are not portable the operator arranges collection (GPSR Article 37(5)).
May we ask consumers to throw the product away?
Disposal may be included in the actions consumers are asked to take only where it can be done easily and safely, and it does not affect their right to a refund or replacement (GPSR Article 37(4)).
Does the recall remedy replace the legal guarantee?
No. Article 37 applies without prejudice to Directives (EU) 2019/770 and (EU) 2019/771, and repair by the consumer does not deprive the consumer of the rights under those directives (GPSR Article 37(1) and 37(3)).
How is this different from writing the recall notice?
The notice is the message (GPSR Article 36). The remedy is what the consumer receives (Article 37). The notice must describe the remedies, so decide the remedies first.
