The person who knew our compliance has left
EU product duties belong to the company, not to the employee who handled them. The manufacturer must still keep files up to date, investigate complaints, notify dangerous products and answer authorities. Secure the departing person's files and accounts, rebuild an overview of products, documents and open cases, assign each duty to a named role, and write down the routines so the next change does not reset them.

Why this happens
Compliance knowledge often lives in one head and one mailbox, but the law does not address individuals. The General Product Safety Regulation (EU) 2023/988 places its duties on economic operators. The manufacturer carries out an internal risk analysis and draws up technical documentation before placing a product on the market, keeps it up to date, and keeps it available to market surveillance authorities for 10 years (Article 9(2) and (3)). It keeps procedures so that products produced in series stay in conformity (Article 9(4)).[1]
Some duties are triggered by events and cannot pause. Where a manufacturer has reason to believe a product it placed on the market is dangerous, it must immediately take corrective measures, inform consumers and inform the authorities through the Safety Business Gateway (Article 9(8)). It keeps other operators in the supply chain informed of safety issues (Article 9(10)), investigates complaints and accident information and keeps an internal register of complaints, recalls and corrective measures (Article 9(12)). An accident caused by the product is notified through the Safety Business Gateway without undue delay (Article 20(1)). Importers have parallel duties (Article 11). Under Article 2(1), third subparagraph, point (b), Chapter III Section 1 (Articles 9 to 18) does not apply to products subject to Union harmonisation legislation; the accident duty in Article 20 sits in Section 2, which that point does not exclude.[1]
For CE-marked products the sector act sets the duties. Under the Low Voltage Directive 2014/35/EU the manufacturer keeps the technical documentation and declaration for 10 years (Article 6(3)), takes changes in design and standards into account (Article 6(4)), acts immediately on non-conformity and informs authorities where the equipment presents a risk (Article 6(8)), and provides documentation on a reasoned request (Article 6(9)). An authorised representative can hold the file and answer authorities, but drawing up the technical documentation cannot be part of its mandate (Article 7).[2]
Authorities deal with whoever represents the product in the Union. For products under the acts listed in Article 4(5) of Regulation (EU) 2019/1020, the EU-based operator verifies that the declaration and technical documentation exist, provides documentation on reasoned request, informs authorities of risks and cooperates on corrective action (Article 4(3)). Its name and contact details are on the product, packaging, parcel or an accompanying document (Article 4(4)). A staff change does not change who that operator is.[3]
How to solve it
-
Secure files, mailboxes and accounts first
Before access is closed, export or transfer the person's compliance mailbox, drive folders and accounts with test labs, notified bodies, supplier portals and authority systems such as the Safety Business Gateway. Keep the originals unchanged.
-
List the open cases
Look for complaints under investigation, authority requests with deadlines, corrective actions in progress, certificates about to expire and promises made to customers. Each open case gets a new owner and a date.
-
Rebuild the product overview
Make a list of the products on the market with the acts that apply, the declaration, the technical file, the test reports and the responsible EU operator. Mark what is current, what is missing and what only the former employee understood.

Assign each legal duty to a role
Write down who keeps the technical files up to date, who handles complaints and the complaints register, who notifies dangerous products, and who answers authorities. Name a deputy for each, so one absence does not stop the duty.
-
Train the successor and write the routine down
Give the new owner a structured route through the basics of EU product compliance and a written procedure for each duty: when it is triggered, what to check, what to file. Review it after the first real case.

| Document | Where it comes from | Legal ground |
|---|---|---|
| An inventory of products, files and open cases at the handover date | Your own compliance records | GPSR Article 9(2)–(3); Directive 2014/35/EU Article 6(3) |
| A responsibility matrix: duty, owner, deputy, source in the act | Management | GPSR Articles 9(8), 9(12) and 20(1) |
| The complaints register, with open investigations marked | The manufacturer or importer | GPSR Articles 9(12) and 11(10) |
If you do nothing
Files must stay current whoever is in the job
Manufacturers ensure the technical documentation is up to date and keep it at the disposal of market surveillance authorities for 10 years (GPSR Article 9(3)).[1]
A dangerous product still triggers immediate action
Where a manufacturer has reason to believe a product it placed on the market is dangerous, it must immediately take corrective measures, inform consumers and inform the authorities through the Safety Business Gateway (GPSR Article 9(8)). For CE-marked electrical equipment, Directive 2014/35/EU Article 6(8) sets a parallel duty.[1]
Authority requests do not wait for a new hire
The EU-based operator must provide an authority, on reasoned request, with all information and documentation needed to demonstrate conformity, and cooperate on corrective action (Regulation (EU) 2019/1020 Article 4(3)(b) and (d)).[3]
Questions about this problem
Is the former employee personally responsible for old products?
The acts place the duties on economic operators: the manufacturer, importer, distributor or authorised representative (GPSR Articles 9 to 12; Directive 2014/35/EU Articles 6 to 8). They stay with the company when an employee leaves.
Can an authorised representative take over the work?
Partly. Under the low voltage directive an authorised representative can hold the declaration and technical documentation for authorities and answer their requests, but drawing up the technical documentation and the design and manufacturing duty cannot be part of its mandate (Directive 2014/35/EU Article 7(1)–(2)). If the mandate says so, it may draw up the declaration (Annex III point 5).
What if we cannot find a declaration or a test report?
Ask the issuer for a copy first: the test lab, the notified body or the supplier. Where evidence cannot be recovered, rebuild it before placing more units on the market, because the file must exist and be up to date (GPSR Article 9(2)–(3); Directive 2014/35/EU Article 6(2)–(3)).
Who should own compliance after this?
The law does not prescribe a job title. It sets duties for the company. Assign each duty to a role with a deputy, and make sure the person in the role has access to the files and the authority systems.
