We have to report in the Safety Business Gateway
The Safety Business Gateway is the Commission's web portal through which economic operators and online marketplaces inform market surveillance authorities under the General Product Safety Regulation (Article 27). It carries the notification of a dangerous product and its corrective measures (Articles 9(8), 11(8) and 12(4)), accident notifications (Article 20) and marketplace reports (Article 22). State the product, the risk, the measures taken and the quantities per Member State.

Why this happens
The General Product Safety Regulation (EU) 2023/988 gives companies one door to the authorities. Article 27 requires the Commission to maintain a web portal through which economic operators and providers of online marketplaces provide market surveillance authorities and consumers, in an easy way, with the information required by Article 9(8) and (9), Article 10(2), point (c), Article 11(2) and (8), Article 12(4), and Articles 20 and 22: the Safety Business Gateway. The Commission draws up guidelines for its practical use.[1]
The duties behind those article numbers are the ones that arise when something has gone wrong. A manufacturer who has reason to believe a product it placed on the market is dangerous informs, through the Safety Business Gateway, the market surveillance authorities of the Member States where the product was made available, giving details of the risk, of any corrective measure already taken and, if available, of the quantity of products still circulating by Member State (Article 9(8)). Importers inform the same authorities (Article 11(8)) and distributors ensure they are informed (Article 12(4)); an authorised representative reports actions under its mandate where the manufacturer has not (Article 10(2)(c)); a manufacturer notifies an accident, with the product's type and identification number and the circumstances, to the Member State where it occurred (Article 20); and marketplaces report dangerous products offered through their services of which they have actual knowledge (Article 22(12)(d)).[1]
The Commission's portal describes the practice: businesses report dangerous products and accidents to the Member State authorities; the regulation makes the use of the Safety Business Gateway compulsory for those notifications; submission is reserved for the operators and marketplaces concerned, and third-party submission is prohibited. National authorities may use a submission to create an alert in the Safety Gate Rapid Alert System, and a summary is then published on the public Safety Gate portal.[3]
That is where the two systems meet. Member States notify corrective measures against dangerous products through the Safety Gate Rapid Alert System (Article 26), and the Safety Gate Portal gives the public access to selected information from those notifications and carries the information manufacturers provide to alert consumers (Articles 9(9) and 34). Once notified, the authority may request progress reports and may decide whether or when the corrective measure is completed (Article 15(6)).[1]
Market surveillance of the product itself follows Regulation (EU) 2019/1020, under which the authority ensures the withdrawal, recall or prohibition where the operator fails to act (Article 16(5)).[2]
How to solve it
-
Check which duty you are reporting under
A manufacturer notifies corrective measures for a dangerous product; an importer informs the authorities of its own, and a distributor ensures they are informed; the manufacturer notifies accidents; an authorised representative reports the actions taken under its mandate where the manufacturer has not; a marketplace reports dangerous products offered through it. Each duty names who reports and to which Member States.
-
Gather what the notification must say
For a corrective measure: the risk to health and safety, the corrective measures already taken and, if available, the quantity of products still circulating by Member State. For an accident: the type and identification number of the product and the circumstances, if known. A distributor gives the details it has on the risk, the number of products and the measures taken.
-
Address the right Member States
Corrective measures go to the authorities of the Member States in which the product has been made available on the market. An accident is notified to the competent authorities of the Member State where it occurred. Sales data per country tells you which ones.
-
Know which national authority will handle it
The notification reaches the market surveillance authority of each Member State you select. Knowing who that authority is, and how it works, helps when it comes back with questions or a request for progress reports.

Submit, and keep the confirmation with the case
Submission is reserved for the economic operators and marketplaces concerned by the product. File the notification, the date and the authority's replies with the risk assessment and the register entry, so that the corrective measure has one record from first alert to closure.

Expect the follow-up
The national authority may use the notification to create an alert in the Safety Gate Rapid Alert System, and a summary is then published on the public Safety Gate portal. The information meant to alert consumers is made available through the Safety Gate Portal without undue delay. Authorities may ask for regular progress reports and decide when the measure is completed.

What you need to show
| Document | Where it comes from | Legal ground |
|---|---|---|
| The notification and its confirmation | You, in the Safety Business Gateway | GPSR Article 27 |
| The risk description and the corrective measures taken | Your risk assessment and recall record | GPSR Article 9(8), second subparagraph |
| Quantities still circulating, by Member State | Your sales and stock data | GPSR Article 9(8), second subparagraph |
| The register entry | Your internal register of complaints, recalls and corrective measures | GPSR Article 9(12) |
If you do nothing
The authority acts on the information, or on its absence
Where an operator fails to take corrective action or the risk persists, the authority ensures the withdrawal, recall or prohibition itself and informs the public (Regulation (EU) 2019/1020, Article 16(5)).[2]
The case stays open
Market surveillance authorities may request regular progress reports and decide whether or when the corrective measure can be considered completed (GPSR Article 15(6)).[1]
Penalties under national law
Each Member State lays down effective, proportionate and dissuasive penalties for infringements of the regulation (GPSR Article 44).[1]
Questions about this problem
Is the Safety Business Gateway mandatory?
Yes. The GPSR names it as the channel for the notifications under Articles 9(8) and (9), 10(2)(c), 11(2) and (8), 12(4), 20 and 22 (Article 27), and the Commission states that the regulation makes its use compulsory for those notifications.
Can our consultant or lawyer submit on our behalf?
The Commission's portal states that submission is reserved for the economic operators and providers of online marketplaces concerned by the notified product, and that submission by third parties is prohibited. Ask your adviser to prepare the content; the operator submits.
Does the notification become public?
The national authority may use it to create an alert in the Safety Gate Rapid Alert System, and a summary of that alert is published on the public Safety Gate portal (GPSR Articles 26 and 34).
Do we notify each country separately?
One portal serves all Member States; the notification is addressed to the authorities of the Member States where the product was made available (GPSR Article 9(8)(c)), or, for an accident, of the Member State where it occurred (Article 20(1)).
We are a distributor and the manufacturer has already notified. Do we notify again?
The distributor's duty is to ensure that the authorities are informed (GPSR Article 12(4)(c)). Where the manufacturer's notification covers the product and the markets you sold in, confirm that with the manufacturer and keep the confirmation.
