Our product falls under an ecodesign regulation
Products covered by an implementing regulation under the Ecodesign Directive 2009/125/EC may only be placed on the market if they meet it and carry the CE marking. Regulation (EU) 2024/1781 repealed the directive from 18 July 2024, but its implementing regulations still apply. Check the requirements and dates, assess conformity, sign the declaration and keep the documents for 10 years after the last unit was made.

Why this happens
The Ecodesign Directive 2009/125/EC is a framework. It does not set limits itself; implementing measures for defined products do (Article 2(3)). Products covered by an implementing measure may be placed on the market or put into service only if they comply with it and bear the CE marking (Article 3(1)). Before that, the manufacturer or its authorised representative ensures that conformity is assessed (Article 8(1)), affixes the CE marking and issues an EC declaration of conformity with the elements of Annex VI that refers to the measure (Article 5(1) and (3)).[1]
The conformity route is light by default. Implementing measures leave manufacturers the choice between internal design control (Annex IV) and a management system (Annex V), and specify other modules only where duly justified and proportionate to the risk (Article 8(2)). Regulation (EU) 2019/1782 on external power supplies is a typical example: it applies from 1 April 2020, sets limits and information requirements in Annex II, and names the technical documentation content for the conformity assessment (Articles 3, 4 and 9). Regulation (EU) 2025/2052, adopted under the same directive, repeals it from 14 December 2028 (Articles 8 and 10).[1][3][5]
The paperwork must last. The documents relating to the conformity assessment and the declarations are kept available for 10 years after the last of the product has been manufactured and provided within 10 days of a request (Article 8(3)), in an official language of the Union (Article 8(4)). Where the manufacturer is outside the Union and has no authorised representative, the importer ensures compliance and keeps and makes available the declaration and the technical documentation (Article 4). Regulation (EU) 2019/1020 adds that, for products under the directive, an economic operator established in the Union must be responsible and named on the product, its packaging, the parcel or an accompanying document (Article 4(1), (4) and (5)).[1][4]
Regulation (EU) 2024/1781 replaced the framework, not the measures. It repealed the directive from 18 July 2024, but key provisions, including those on CE marking, declaration and conformity assessment, continue to apply to products regulated by implementing measures until those measures are repealed or declared obsolete (Article 79(1)(b)), and its own market surveillance articles already apply to them (Article 79(2)). New requirements come by delegated act and normally apply no earlier than 18 months after their entry into force (Article 4(4)); the first could not enter into force before 19 July 2025 (Article 4(7)).[2]
How to solve it
-
Find the implementing regulation and its dates
Each product group has its own implementing regulation with a scope, definitions, requirements and application dates in its annexes, for example Regulation (EU) 2019/2020 for light sources or Regulation (EU) 2019/1782 for external power supplies, which Regulation (EU) 2025/2052 replaces from 14 December 2028. Read the scope and exemptions first; then list the requirements that apply to your models and from when.

Assess conformity with the route the measure allows
Before placing the product on the market, the manufacturer or its authorised representative ensures that its conformity with all relevant requirements is assessed. The implementing measure specifies the procedure and normally leaves a choice between internal design control and a management system. It also says what the technical documentation must contain.

Affix the CE marking and sign the declaration
Before the product is placed on the market, the CE marking is affixed and an EC declaration of conformity is issued, containing the elements of Annex VI and referring to the implementing measure. Markings likely to mislead users about the meaning or form of the CE marking are prohibited.
-
As an importer, check who carries the duties
Where the manufacturer is not established in the Union and has no authorised representative, the importer ensures that the product complies and keeps and makes available the declaration and the technical documentation. An economic operator established in the Union must also be responsible for the product and named on it.
-
Be able to produce the file within 10 days
Keep the documents on the conformity assessment and the declarations available for inspection for 10 years after the last of the product was manufactured, in an official language of the Union, and provide them within 10 days of a request from an authority.
-
Watch for delegated acts under the new regulation
New requirements under Regulation (EU) 2024/1781 come by delegated act, normally applying no earlier than 18 months after entry into force. For some product groups listed in its Article 79(1)(a)(i), including external power supplies and computers, the directive's provisions on adopting implementing measures, including its Article 15, continue to apply instead of the Regulation's until 31 December 2026; Regulation (EU) 2025/2052 was adopted that way.

If you do nothing
Authorities can require corrective action, up to withdrawal
The market surveillance articles of Regulation (EU) 2024/1781 apply to products regulated by implementing measures under Directive 2009/125/EC (Article 79(2)). Where authorities have sufficient reason to believe that such a product presents a risk and find it non-compliant, they require corrective action within a reasonable period, which may include preventing it from being made available, withdrawal or recall (Regulation (EU) 2024/1781 Article 69(1); Regulation (EU) 2019/1020 Article 16(3)).[2]
The new market surveillance rules already apply
The market surveillance articles of the Ecodesign Regulation, including the procedure for products presenting a risk and formal non-compliance, apply to products regulated by implementing measures adopted under the directive (Regulation (EU) 2024/1781 Article 79(2)).[2]
Ten days to produce the file
The documents relating to the conformity assessment must be made available within 10 days of receipt of a request by the competent authority of a Member State (Directive 2009/125/EC Article 8(3)).[1]
Questions about this problem
Did the new Ecodesign Regulation cancel our implementing regulation?
No. Regulation (EU) 2024/1781 repealed Directive 2009/125/EC from 18 July 2024, but the directive's provisions on CE marking, conformity assessment and related matters continue to apply to products regulated by its implementing measures until those measures are repealed or declared obsolete (Article 79(1)(b)).
Do we need a notified body?
Normally not. Implementing measures leave manufacturers the choice between internal design control and a management system; modules from Decision No 768/2008/EC are specified only where duly justified and proportionate to the risk (Directive 2009/125/EC Article 8(2)).
Do we need a digital product passport now?
Only when a delegated act under Regulation (EU) 2024/1781 requires one for your product group (Article 9(1)). Implementing measures under the old directive do not create one.
In which language must the documents be?
Documents on the conformity assessment and the declaration are drawn up in one of the official languages of the Union (Directive 2009/125/EC Article 8(4)). Member States may require the user information to be in their official language when the product reaches the end-user (Article 5(5)).
What changes when a delegated act replaces our implementing regulation?
The delegated act sets the new requirements and the conformity assessment, and normally applies no earlier than 18 months after its entry into force (Regulation (EU) 2024/1781 Article 4(4) and (5)). For products placed on the market under the old rules before then, the 10-year documentation duty continues (Article 79(4)).
