Our sustainability report needs product compliance data
Under the Accounting Directive as amended by Directive (EU) 2026/470, undertakings above EUR 450 million net turnover and 1 000 employees will report on sustainability impacts, including products and value chain, for financial years from 1 January 2027 under national law. Product compliance data feeds that report, and some product laws, such as the ESPR, let you place their disclosures in it. Map each disclosure to one product data source.

Why this happens
Sustainability reporting sits in the Accounting Directive, Directive 2013/34/EU, as amended by the Corporate Sustainability Reporting Directive and, in February 2026, by Directive (EU) 2026/470. The directive is addressed to Member States and applies through national law. In the consolidated text of 18 March 2026, Article 19a(1) requires undertakings that exceed a net turnover of EUR 450 million and an average of 1 000 employees to include in the management report the information needed to understand their impacts on sustainability matters and how sustainability matters affect them. Member States must transpose the 2026 amendments by 19 March 2027 (Directive (EU) 2026/470 Article 5(1)), and apply the new thresholds for financial years starting on or after 1 January 2027 (Directive (EU) 2022/2464 Article 5(2), as amended).[1][2]
The content list in Article 19a(2) reaches into products. It covers the business model and strategy, time-bound targets, policies, the due diligence process, the principal actual or potential adverse impacts connected with the undertaking's own operations and its value chain, including its products and services, its business relationships and its supply chain, and indicators for these. Article 19a(3) adds that the information covers the value chain where applicable.[1]
The 2026 amendment also set a value chain cap. A protected undertaking, with up to 1 000 employees and in the value chain of a reporting undertaking, may decline to provide information that exceeds the voluntary standards; the reporting undertaking may rely on its self-declaration and must tell it which requests go beyond the standards (Article 19a(3)). The standards were set by Commission Delegated Regulation (EU) 2026/1560, whose Article 3 on the cap applies from financial years beginning on or after 1 January 2027.[1][5]
Product laws add their own disclosures that can be placed in the report. Under the Ecodesign for Sustainable Products Regulation, economic operators that discard unsold consumer products disclose yearly the number and weight per category, the reasons, the share sent to reuse, recycling, recovery or disposal, and their prevention measures, and those subject to sustainability reporting may include this there (Regulation (EU) 2024/1781 Article 24(1)). From 19 July 2026, large enterprises may not destroy the unsold apparel, clothing accessories and footwear listed in Annex VII (Article 25(1)), except under the derogations in Commission Delegated Regulation (EU) 2026/296.[3][6]
Under the EU Deforestation Regulation, operators that are not SMEs report publicly every year on their due diligence system and may do so in reporting under other Union value chain due diligence acts (Regulation (EU) 2023/1115 Article 12(3)).[4]
How to solve it
-
Confirm whether and from when the company reports
The thresholds in Article 19a of the Accounting Directive were raised by Directive (EU) 2026/470, which Member States must transpose by 19 March 2027. The new thresholds apply for financial years starting on or after 1 January 2027; for 2024 to 2026 the earlier scope applies, and Member States may exempt companies below the new thresholds for 2025 and 2026. Ask finance which year applies under national law, and whether a parent company reports for the group.
-
List the disclosures that touch products
The report covers the business model, targets, policies, due diligence, the principal adverse impacts in the value chain including products and services, and the indicators for them. Mark the points where product data is the evidence: materials and substances, suppliers, incidents and corrective actions, and end-of-life.
-
Map the product data you already hold
Most of the input exists in product compliance files: declarations of conformity, test reports, substance and material data, packaging data, deforestation due diligence and supplier documents. Keep one source per data point so the report and the product files cannot diverge.
Product validationCompliance engine Open in the console -
Reuse the disclosures product laws already require
Large companies that discard unsold consumer products must disclose numbers, weights, reasons and destinations every year, and may put that disclosure in the sustainability report. EUDR operators that are not SMEs report publicly on their due diligence system and may do so through reporting under other value chain due diligence acts.
-
Respect the limit on what you ask suppliers
Suppliers with up to 1 000 employees may decline sustainability reporting requests that go beyond the voluntary standard, and you must tell them which questions go beyond it. Plan the value chain data around what you hold and what the voluntary standard covers.

If you do nothing
Value chain information is expected, with a short grace period
The report covers the undertaking's own operations and its value chain, including products and services. For the first three years, where value chain information is missing, the undertaking explains its efforts to obtain it and the reasons it could not (Directive 2013/34/EU Article 19a(3)).[1]
Over-reaching supplier clauses are not binding
Contract clauses that require protected undertakings to provide more than the voluntary standard specifies, for sustainability reporting purposes, are not binding, while the rest of the contract stands (Directive 2013/34/EU Article 19a(3)).[1]
Unsold goods rules apply on their own
Large economic operators that discard unsold consumer products must disclose it yearly on their website, and from 19 July 2026 large enterprises may not destroy the unsold apparel, clothing accessories and footwear listed in Annex VII (Regulation (EU) 2024/1781 Articles 24(1) and 25(1)).[3]
Questions about this problem
We are below the thresholds. Does this concern us?
As a supplier, yes. If you have up to 1 000 employees and are in the value chain of a reporting undertaking, you are a protected undertaking and may decline requests that go beyond the voluntary standard (Directive 2013/34/EU Article 19a(3)). You may also report voluntarily under Delegated Regulation (EU) 2026/1560.
Does the unsold goods disclosure belong in the sustainability report?
It may. Economic operators that discard unsold consumer products disclose the information on an easily accessible page of their website, and those subject to sustainability reporting may also include it there (Regulation (EU) 2024/1781 Article 24(1)). Micro and small enterprises are exempt; medium-sized ones follow from 19 July 2030.
Can our EUDR report go into the sustainability report?
Possibly. Operators that also fall under other Union acts laying down value chain due diligence requirements may meet the EUDR public reporting duty by including the required information in that other reporting (Regulation (EU) 2023/1115 Article 12(3)). Whether a sustainability statement under the Accounting Directive counts as such reporting is a question of interpretation; check it before relying on it.
Are there exceptions to the destruction ban?
Yes, ten, set by Commission Delegated Regulation (EU) 2026/296 under Article 25(5) of the ESPR and applicable from 19 July 2026. They include dangerous or non-compliant products, intellectual property infringements, damage that cannot be repaired cost-effectively, and products that social economy entities did not accept as a donation after an offer of at least eight weeks (Article 2). Keep the documentation for five years (Article 3).
