# SPVD — Simple Pressure Vessels Directive

The Simple Pressure Vessels Directive sets safety requirements, notified-body assessment, CE marking and inscriptions for series-made welded vessels holding air or nitrogen above 0,5 bar, binding manufacturers, importers and distributors. It has applied since 20 April 2016, replacing Directive 2009/105/EC, and Directive (EU) 2024/2749 adds emergency procedures that apply from 30 May 2026.

## Key facts

- **Official title:** Directive 2014/29/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of simple pressure vessels (recast)
- **Reference:** Directive 2014/29/EU
- **CELEX:** 32014L0029
- **Act type:** Directive
- **In force:** 2014-04-18
- **Applies from:** 2016-04-20
- **Enforced by:** National market surveillance authorities enforce the national laws transposing the directive; Article 34 still cites Article 15(3) and Articles 16 to 29 of Regulation (EC) No 765/2008, read as Regulation (EU) 2019/1020 since 16 July 2021, whose Annex I lists the directive as point 48, whose Article 18 replaces the Article 21 of Regulation (EC) No 765/2008 that Article 35(1) cites, and whose Article 4 requires an economic operator established in the Union for every simple pressure vessel placed on the market. In Denmark the directive is implemented by executive order nr. 1304 of 23 November 2015 on the construction of simple pressure vessels (bekendtgørelse om indretning m.v. af simple trykbeholdere), which reproduces the directive as its annex 1, requires the Annex III point 2 instructions in Danish and lets the authority designate the Danish notified bodies on the basis of DANAK accreditation; the product act (lov om produkter og markedsovervågning, LBK nr. 22 of 8 January 2026) lists the directive in section 2 as product area nr. 7 and names Erhvervsstyrelsen as the control authority, a task carried out since 1 December 2018 by Sikkerhedsstyrelsen, since January 2026 the department Markedsovervågning of Erhvervsstyrelsen, while the control authority's own guidance states that Arbejdstilsynet remains the market surveillance authority for pressure equipment made to order and for equipment imported from third countries for offshore oil and gas activities under the offshore safety act. That split works through section 9(2) of the product act, under which the authority that supervises other legislation on specific risks for particular products is the relevant control authority; since amending order nr. 492/2026 replaced every mention of Arbejdstilsynet in the simple pressure vessel order, no executive order names it for these products. Note also that the 'made to order' leg cannot reach a simple pressure vessel: Article 1(1) covers only vessels manufactured in series, so a one-off vessel is outside this directive altogether. In practice only the offshore leg can bite here. Amending order nr. 492 of 28 May 2026, in force 30 May 2026, moved the order onto the product act, replaced Arbejdstilsynet by Erhvervsstyrelsen throughout, including the designation of notified bodies, and added the emergency procedures as new sections 6 a to 6 c. The toolkit is corrective action, withdrawal or recall within a reasonable period commensurate with the nature of the risk, provisional measures prohibiting or restricting the making available, orders to end formal non-compliance such as a missing CE marking, notified body number, Annex III inscription, EU declaration of conformity or technical documentation, and national penalties that must be effective, proportionate and dissuasive and may include criminal penalties for serious infringements.
- **Category:** CE / Product Safety

## Who it applies to

**Covered by the act:** Simple pressure vessels manufactured in series that meet all five characteristics of Article 1(1): welded and intended to be subjected to an internal gauge pressure greater than 0,5 bar and to contain air or nitrogen and not intended to be fired; parts and assemblies contributing to the strength of the vessel under pressure made of non-alloy quality steel or of non-alloy aluminium or non-age hardening aluminium alloys; built either as a cylindrical part of circular cross-section closed by outwardly dished or flat ends revolving around the same axis, or as two dished ends revolving around the same axis; a maximum working pressure of no more than 30 bar and a product of that pressure and the capacity (PS times V) of no more than 10 000 bar.L; and a minimum working temperature no lower than minus 50 °C with a maximum working temperature no higher than 300 °C for steel and 100 °C for aluminium or aluminium alloy vessels; Vessels whose PS times V exceeds 50 bar.L, which must satisfy the Annex I essential safety requirements, go through EU-type examination and a production module with a notified body, bear the CE marking, the notified body number and the Annex III inscriptions and be covered by an EU declaration of conformity; Vessels whose PS times V is 50 bar.L or less, which must be designed and manufactured in accordance with the sound engineering practice in one of the Member States and bear the Annex III inscriptions, and whose instructions and safety information must still accompany them; The making available on the market and the putting into service of such vessels, which Member States may allow only where the vessels satisfy the directive when properly installed and maintained and used for the purposes for which they are intended; The economic operators in the chain: manufacturers, including anyone who has a vessel designed or manufactured and markets it under his own name or trade mark, authorised representatives, importers and distributors

**Derived and downstream products:** The directive excludes only three groups: vessels specifically designed for nuclear use whose failure may cause an emission of radioactivity, vessels specifically intended for installation in or the propulsion of ships and aircraft, and fire extinguishers (Art. 1(2)(a) to (c)). Everything else that meets the five Article 1(1) characteristics is inside, including air receivers built into vehicles, machines and pneumatic systems; The Article 1(1) characteristics are cumulative: a vessel that is not welded, holds a fluid other than air or nitrogen, is intended to be fired, is not manufactured in series, uses other strength-bearing materials, has another shape, exceeds 30 bar or 10 000 bar.L or falls outside the temperature window is not a simple pressure vessel. Directive 2014/68/EU on pressure equipment excludes only simple pressure vessels covered by this directive, so such a vessel is assessed against that directive's own scope and thresholds; PS is the maximum gauge pressure which may be exerted under normal conditions of use, V is the capacity of the vessel in litres and the design pressure P is the gauge pressure the manufacturer chooses to determine the thickness of the pressurised parts; Tmin and Tmax are the lowest and highest stabilised temperatures the wall may attain under normal conditions of use (Annex III, point 3.1); There is series manufacture when more than one vessel of the same type is manufactured during a given period by a continuous manufacturing process, in accordance with a common design and using the same manufacturing processes; vessels form part of the same family if they differ from the prototype only in diameter or in the length of the cylindrical portion within the Annex III limits, and a batch consists of at most 3 000 vessels of the model of the same type (Annex III, points 3.1(f), (g) and (h)); Chapter 3 of the directive, which carries the presumption of conformity, the conformity assessment procedures, the EU declaration of conformity and the CE marking rules, applies by its own heading only to vessels of which the product of PS times V exceeds 50 bar.L, and Annex III point 1.1 requires the CE marking only for those vessels; An importer or distributor that places a vessel on the market under its own name or trade mark, or modifies a vessel already placed on the market in such a way that compliance may be affected, is considered a manufacturer and carries the Article 6 obligations; Vessels above 50 bar.L that conform to harmonised standards or parts of them whose references have been published in the Official Journal are presumed to conform to the essential safety requirements those standards cover; the references are published by Commission communication, most recently OJ C 326 of 14 September 2018, and the Commission hosts the SPVD Guidelines, the unanimous opinion of the Working Group Pressure, which are not legally binding (Art. 12; European Commission, simple pressure vessels pages); The directive leaves untouched the right of Member States to specify the requirements they deem necessary to protect workers using vessels, provided the vessels are not modified in a way the directive does not specify (Art. 3(2))

**Roles under the act:**

- **Manufacturer (including brand owners and anyone who has vessels made for them)** — Any natural or legal person who manufactures a vessel or has a vessel designed or manufactured, and markets that vessel under his name or trade mark; an importer or distributor that places a vessel on the market under its own name or trade mark, or modifies a vessel already placed on the market in such a way that compliance may be affected, is considered a manufacturer and takes on the Article 6 obligations.
- **Authorised representative** — Any natural or legal person established within the Union who has received a written mandate from a manufacturer to act on his behalf in relation to specified tasks; the obligation to design and manufacture to the essential safety requirements or to sound engineering practice and the obligation to draw up the technical documentation cannot form part of the mandate.
- **Importer** — Any natural or legal person established within the Union who places a vessel from a third country on the Union market.
- **Distributor (wholesaler, retailer or dealer supplying simple pressure vessels)** — Any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes a vessel available on the market.

- 2018-12-01: Sikkerhedsstyrelsen takes over the control of pressure equipment and simple pressure vessels in Denmark, while the control authority's own guidance states that Arbejdstilsynet remains the market surveillance authority for pressure equipment made to order and for equipment imported from third countries for offshore oil and gas activities under the offshore safety act. In practice only the offshore leg can bite here
- 2021-07-16: Regulation (EU) 2019/1020 applies: it deletes the market surveillance articles of Regulation (EC) No 765/2008 that Articles 34 and 35 cite, lists the directive as point 48 of its Annex I and, under Article 4, requires an economic operator established in the Union for every simple pressure vessel placed on the market

- 2026-05-30: National measures transposing Directive (EU) 2024/2749 apply, so the emergency procedures of Articles 38a to 38e can be activated; in Denmark executive order nr. 492 of 28 May 2026 in force, which places the simple pressure vessel order under the product act, replaces Arbejdstilsynet by Erhvervsstyrelsen, inserts the emergency procedures as § 6 a to § 6 c, extends the fine provision and reissues the directive as amended as annex 1

## What you must do

### Manufacturer (including brand owners and anyone who has vessels made for them)

- Establish first whether the vessel is a simple pressure vessel at all by testing it against the five cumulative characteristics of Article 1(1) and the three exclusions of Article 1(2), then multiply the maximum working pressure PS in bar by the capacity V in litres: above 50 bar.L the vessel must be designed and manufactured to the Annex I essential safety requirements, at 50 bar.L or less to the sound engineering practice in one of the Member States.
- Choose materials that meet Annex I point 1: pressurised parts capable of being welded, ductile and tough so that a rupture at the minimum working temperature does not give rise to fragmentation or brittle-type fracture, and not adversely affected by ageing, accompanied by an inspection slip drawn up by the producer of the materials. Non-alloy quality steels must be non-effervescent and supplied after normalisation treatment or an equivalent state, with carbon below 0,25 % and sulphur and phosphorus each below 0,05 %, a maximum tensile strength below 580 N/mm2, the Annex I point 1.1.1 elongation values and an average bending rupture energy KCV of at least 35 J/cm2 on three longitudinal test pieces at the minimum working temperature, with no more than one figure below 35 and none below 25, checked where the minimum working temperature is below minus 10 °C and the wall thickness exceeds 5 mm. Non-alloy aluminium must contain at least 99,5 % aluminium and the Article 1(1)(b) alloys must resist intercrystalline corrosion at the maximum working temperature, be supplied annealed, have a maximum tensile strength of no more than 350 N/mm2 and elongation after fracture of at least 16 % parallel and 14 % perpendicular to the direction of rolling. Welding materials must suit and be compatible with the materials welded, and accessories contributing to strength and unpressurised parts must be compatible with the pressurised parts.
- Design to Annex I point 2: define the use, select the minimum and maximum working temperatures and the maximum working pressure PS, and satisfy the material qualities at minus 10 °C where a higher minimum working temperature is chosen; make the inside inspectable and the vessel drainable, keep the mechanical qualities throughout the period of use, protect against corrosion, keep the vessel from stresses likely to impair safety and keep the internal pressure from permanently exceeding PS, which it may exceed momentarily by up to 10 %; make circumferential and longitudinal seams with full penetration welds or welds of equivalent effectiveness and give convex ends other than hemispherical ones a cylindrical edge. Determine the wall thickness by the calculation method or the experimental method where PS times V is not more than 3 000 bar.L, and by the calculation method alone where it is more than 3 000 bar.L or the maximum working temperature exceeds 100 °C, keeping the actual thickness of the cylindrical section and the ends at no less than 2 mm for steel and 3 mm for aluminium or aluminium alloy.
- Control the manufacturing process under Annex I point 3: prepare the component parts without surface defects, cracks or changes in the mechanical characteristics detrimental to safety; make welds on pressurised parts with characteristics similar to the welded materials and free of surface or internal defects, performed by qualified welders or operators possessing the appropriate level of competence in accordance with approved welding processes, where the approval and qualification tests are carried out by notified bodies; and ensure consistent weld quality during manufacture through appropriate tests using adequate procedures, recorded in a report.
- For vessels above 50 bar.L, lodge an application for EU-type examination (Module B) with a single notified body of your choice before manufacture, with a written declaration that the same application has not been lodged elsewhere and the Annex II point 1.3 technical documentation, which must include an adequate analysis and assessment of the risks, a general description, conceptual design and manufacturing drawings with the explanations needed to understand them, the list of harmonised standards applied in full or in part or descriptions of the solutions adopted instead, design calculations and examination results, test reports, the Annex III point 2 instructions and a document describing the materials, welding processes and checks selected, plus the supporting evidence and, where a prototype is examined, the welding qualification certificates, the material inspection slip and a report on the examinations and tests. Where the vessel follows harmonised standards you may choose design type or production type; where it does not, or only partly, you must submit a prototype for production-type examination. Inform the body of every modification to the approved type and keep the certificate, its annexes and additions with the technical documentation at the disposal of the national authorities for 10 years.
- For vessels above 50 bar.L, lodge an application for EU-type examination (Module B) with a single notified body before manufacture, with a written declaration that it has not been lodged elsewhere; submit a prototype where harmonised standards were not, or only partly, followed.
- Draw up the Annex II point 1.3 technical documentation: general description, design and manufacturing drawings, standards or solutions applied, design calculations, test reports, the instructions and the materials, welding processes and checks selected.
- Include in the technical documentation an adequate analysis and assessment of the risks.
- Inform the notified body of every modification to the approved type that may affect conformity or the conditions of validity of the certificate.
- Keep the EU-type examination certificate, its annexes and additions with the technical documentation at the disposal of the national authorities for 10 years after the vessel was placed on the market.
- Run the production module that matches the band before placing the vessel on the market: above 3 000 bar.L Module C1 only; above 200 bar.L and up to 3 000 bar.L Module C1 or Module C2 at your choice; above 50 bar.L and up to 200 bar.L Module C1 or Module C at your choice. Under Module C1 present the vessels in uniform batches of at most 3 000 vessels of the model of the same type, and the notified body performs a hydrostatic test or a pneumatic test of equivalent effect on each vessel at a pressure equal to 1,5 times the design pressure, tests test-pieces on the longitudinal welds and repeats them on the circumferential welds where the technique differs, or for the experimental design method runs a hydrostatic test on five vessels taken at random from each batch, affixes its identification number to each vessel of an accepted batch and issues a written certificate of conformity you must be able to supply on request. Under Module C2 the body carries out checks on random samples at random intervals and verifies that you actually test every vessel at 1,5 times the design pressure through staff independent of production. Under Module C the notified body that issued the EU-type examination certificate examines your manufacturing and inspection documents before manufacture begins. Draw up all records and correspondence in an official language of the notified body's Member State or in a language it accepts.
- Draw up the EU declaration of conformity on the Annex IV model, stating that fulfilment of the Annex I essential safety requirements has been demonstrated, containing the elements specified in the modules used, kept continuously updated, translated into the languages required by the Member State where the vessel is placed or made available and, where several Union acts require one, drawn up as a single declaration covering them all; affix the CE marking visibly, legibly and indelibly to the vessel or its data plate before placing it on the market, with the last two digits of the year in which it was affixed and followed by the identification number of the notified body involved in the production control phase, which the body affixes itself or has you affix under its instructions. Apply the Annex III inscriptions to the vessel or its data plate: the maximum working pressure PS in bar, the maximum working temperature Tmax and the minimum working temperature Tmin in °C, the capacity V in L, your name, registered trade name or registered trade mark and address, and the type and serial or batch identification, with a data plate designed so that it cannot be reused and leaving a vacant space for further information. Supply instructions and safety information repeating those particulars except the serial or batch identification and stating the intended use and the maintenance and installation requirements for vessel safety, clear, understandable and intelligible and in a language easily understood by end-users as determined by the Member State, in Denmark Danish.
- Draw up the EU declaration of conformity on the Annex IV model, keep it continuously updated, translate it into the languages the Member State requires and issue a single declaration where several Union acts apply.
- Affix the CE marking visibly, legibly and indelibly to the vessel or its data plate before placing it on the market, with the last two digits of the year of affixing and followed by the identification number of the notified body involved in production control.
- Apply the Annex III inscriptions to the vessel or a non-reusable data plate: PS, Tmax, Tmin, capacity V, your name, registered trade name or trade mark and address, and the type and serial or batch identification.
- Supply instructions and safety information repeating the inscriptions except the serial or batch identification and stating the intended use and the maintenance and installation requirements, in a language end-users easily understand, in Denmark Danish.
- Keep the technical documentation and the EU declaration of conformity for 10 years after the vessel has been placed on the market, keep procedures in place for series production to remain in conformity taking account of design changes and changes in the harmonised standards or other technical specifications referenced, and where the risks warrant it carry out sample testing of vessels made available, investigate and keep a register of complaints, non-conforming vessels and recalls, keeping distributors informed. If a vessel you placed on the market does not conform, immediately take the corrective measures necessary to bring it into conformity, withdraw it or recall it, and where it presents a risk immediately inform the competent national authorities of the Member States in which you made it available, with details of the non-compliance and the corrective measures; provide all information and documentation demonstrating conformity on reasoned request in a language the authority easily understands, cooperate on any action to eliminate the risks, and be able to identify for 10 years every economic operator who supplied you and every one you supplied. During an activated internal market emergency mode, vessels placed on the market under an Article 38c authorisation bear neither the CE marking nor the Annex III point 1 inscriptions, and you declare on your sole responsibility that they comply with all applicable essential safety requirements and complete the conformity assessment procedures the competent national authority indicates.
- Keep the technical documentation and the EU declaration of conformity for 10 years after the vessel has been placed on the market.
- Keep procedures in place for series production to remain in conformity, taking account of design changes and changes in the harmonised standards or other technical specifications referenced.
- Where the risks warrant it, carry out sample testing of vessels made available, investigate, keep a register of complaints, non-conforming vessels and recalls, and keep distributors informed.
- If a vessel you placed on the market does not conform, immediately take the corrective measures, withdraw it or recall it, and where it presents a risk immediately inform the competent national authorities of the Member States concerned.

## Penalties

Member States lay down the rules on penalties applicable to infringements by economic operators of the provisions of national law adopted under the directive and take all measures necessary to ensure that they are enforced; the penalties must be effective, proportionate and dissuasive and the rules may include criminal penalties for serious infringements. Market surveillance authorities that have sufficient reason to believe a vessel presents a risk to the health or safety of persons, or to domestic animals or property, evaluate it against all the requirements of the directive, require the relevant economic operator without delay to take corrective action, to withdraw the vessel or to recall it within a reasonable period commensurate with the nature of the risk, and inform the relevant notified body; if the operator does not act, they take provisional measures prohibiting or restricting the making available, withdrawing or recalling the vessel and inform the Commission and the other Member States, and a measure no one objects to within three months is deemed justified. Disputed measures go to the Union safeguard procedure, compliant vessels that still present a risk are handled the same way, and formal non-compliance, a CE marking affixed in violation of Article 16 or of Article 30 of Regulation (EC) No 765/2008 or not affixed at all, a wrongly affixed or missing notified body number, missing or wrongly affixed Annex III point 1 inscriptions, an EU declaration of conformity not drawn up or not drawn up correctly, technical documentation that is unavailable or incomplete, absent, false or incomplete manufacturer or importer information, or any other unmet administrative requirement of Article 6 or Article 8, must be ended and otherwise leads to restriction, prohibition, recall or withdrawal. Since 16 July 2021 the surveillance powers come from Regulation (EU) 2019/1020, which lists the directive as point 48 of its Annex I and whose authorities can demand documents and supply-chain information, inspect and check products, require corrective action, prohibit the making available and have vessels withdrawn, recalled or destroyed, with the procedural rights of Article 18 replacing the Article 21 of Regulation (EC) No 765/2008 that Article 35(1) still cites. In Denmark, executive order nr. 1304 of 23 November 2015 punishes with a fine, unless a higher penalty is due under the act on the construction of certain products (lov nr. 155 of 20 February 2013) or other legislation — a subsidiarity clause the 2026 amending order left untouched, although the order itself now rests on the product act — breaches of its § 4 and § 5 and of the provisions of the directive reproduced in its annex 1, from 30 May 2026 also of the Danish or English language requirement for crisis-relevant labelling in § 6 a, stk. 3, and failure to comply with decisions, orders or prohibitions issued under the order, with corporate liability under chapter 5 of the criminal code; the product act lists the directive as product area nr. 7 and gives the control authority orders to warn users, stop misleading marketing, remedy, stop sales or supply, withdraw the product effectively and immediately, recall it from users or destroy it, warnings, prohibitions on placing on the market, making available, supplying or taking into use, orders to stop sales and to remove a wrongly affixed CE marking. The act's own penalty is a fine, which can rise to imprisonment of up to 2 years in aggravating circumstances — danger to safety or health, an accident causing serious injury or death, repetition, or a systematic breach for gain — but that escalation reaches only breaches of the act itself, of the authority's decisions and of Articles 4 and 5 of Regulation (EU) 2019/1020, on the product areas the act lists, of which simple pressure vessels are nr. 7. A breach of the executive order's own rules carries a fine only: the act would have allowed the order to set imprisonment for this product area, and the order does not. The control authority is Erhvervsstyrelsen, whose department Markedsovervågning continues the tasks of Sikkerhedsstyrelsen since January 2026; Arbejdstilsynet remains responsible for vessels made to order and vessels imported for offshore oil and gas activities.

## Checklist

1. Test the vessel against the five cumulative characteristics of Article 1(1): manufactured in series, welded, intended for an internal gauge pressure above 0,5 bar and to contain air or nitrogen, not intended to be fired, strength-bearing parts of non-alloy quality steel or non-alloy or non-age hardening aluminium alloy, one of the two Article 1(1)(c) shapes, maximum working pressure of at most 30 bar and PS times V of at most 10 000 bar.L, minimum working temperature no lower than minus 50 °C and maximum working temperature no higher than 300 °C for steel or 100 °C for aluminium; and confirm it is not one of the three Article 1(2) exclusions, a nuclear vessel, a vessel for installation in or the propulsion of ships and aircraft, or a fire extinguisher.
2. Multiply PS in bar by V in litres. At 50 bar.L or less the vessel follows the sound engineering practice of a Member State, needs no notified body, no EU declaration of conformity and no CE marking under Annex III point 1.1, but the manufacturer must still ensure that the vessel bears the inscriptions laid down in point 1 of Annex III — in practice the point 1.2 particulars and, where a data plate is used, the point 1.3 rule that it cannot be reused and must leave a vacant space, since point 1.1 reserves the CE marking for vessels above 50 bar.L — together with the instructions, while importers and distributors verify the narrower point 1.2 list; above 50 bar.L the full regime of Chapter 3 applies (Article 4).
3. Read the route from the band: above 3 000 bar.L Module B plus Module C1; above 200 bar.L up to 3 000 bar.L Module B plus Module C1 or C2; above 50 bar.L up to 200 bar.L Module B plus Module C1 or Module C (Article 13).
4. Decide your role for each vessel, remembering that placing a vessel on the market under your own name or trade mark, or modifying a vessel already on the market in a way that may affect compliance, makes you the manufacturer with the full Article 6 duties (Article 2 and Article 10).
5. Document the materials: weldable, ductile, tough and non-ageing pressurised parts with the material producer's inspection slip, the steel limits on carbon, sulphur, phosphorus, tensile strength, elongation and bending rupture energy or the aluminium limits on purity, annealing, tensile strength and elongation, and compatible welding materials, strength accessories and unpressurised parts (Annex I, point 1).
6. Fix the design values Tmin, Tmax and PS, make the vessel inspectable and drainable and protect it against corrosion, use full penetration seams, and set the wall thickness by the calculation method or the experimental method, with the calculation method mandatory above 3 000 bar.L or above 100 °C and a minimum actual thickness of 2 mm for steel and 3 mm for aluminium (Annex I, point 2).
7. Qualify the welding: approved welding processes and qualified welders or operators, with the approval and qualification tests carried out by notified bodies, plus weld-quality tests during manufacture recorded in a report (Annex I, point 3).
8. Lodge the EU-type examination application with one notified body of your choice, with the Annex II point 1.3 documentation, supporting evidence and, where the harmonised standards are not applied in full, a prototype, and keep the certificate and documentation for 10 years (Article 13 and Annex II, point 1).
9. Draw up the Annex IV EU declaration of conformity as a single declaration where other Union acts also apply, affix the CE marking with the last two digits of the year and the notified body's identification number, apply the Annex III point 1.2 inscriptions to the vessel or a non-reusable data plate and supply the Annex III point 2 instructions in the required language, in Denmark Danish (Articles 14 and 16, Annex III and executive order nr. 1304/2015, § 5).
10. Set up 10-year retention of the technical documentation and the declaration, 10-year supplier and customer traceability, procedures keeping series production in conformity, sample testing and a complaints register where the risks warrant it, and the corrective-action and notification routine, and check whether an internal market emergency mode has activated the Chapter 5a procedures for your vessels (Articles 6, 11 and 38a).

## Questions

### When did the Simple Pressure Vessels Directive 2014/29/EU start to apply?

The recast directive was adopted on 26 February 2014, published in the Official Journal on 29 March 2014 and entered into force on the twentieth day after publication, 18 April 2014. Member States had to adopt and publish the laws transposing Article 2, Articles 6 to 41, Annex II and Annex IV by 19 April 2016 and apply them from 20 April 2016, and Articles 1, 3, 4 and 5 and Annexes I and III apply from the same date; Directive 2009/105/EC, the codification of Directive 87/404/EEC, was repealed with effect from 20 April 2016. Vessels covered by the old directive, in conformity with it and placed on the market before that date may still be made available and put into service, and certificates issued by approved inspection bodies under it remain valid. Directive (EU) 2024/2749 later added emergency procedures, transposed by 29 May 2026 and applied from 30 May 2026.

### Is my vessel a simple pressure vessel under SPVD, or pressure equipment under the PED?

SPVD covers only vessels that meet all five characteristics of Article 1(1) at once: manufactured in series; welded, intended for an internal gauge pressure above 0,5 bar, intended to contain air or nitrogen and not intended to be fired; with the strength-bearing parts in non-alloy quality steel or in non-alloy aluminium or non-age hardening aluminium alloys; built either as a cylindrical part of circular cross-section closed by outwardly dished or flat ends, or as two dished ends, revolving around the same axis; with a maximum working pressure of at most 30 bar and PS times V of at most 10 000 bar.L; and with a minimum working temperature no lower than minus 50 °C and a maximum working temperature of at most 300 °C for steel and 100 °C for aluminium. Article 1(2) then removes only three groups, vessels specifically designed for nuclear use whose failure may emit radioactivity, vessels specifically intended for installation in or the propulsion of ships and aircraft, and fire extinguishers. A vessel that misses any Article 1(1) characteristic is not a simple pressure vessel, and because Directive 2014/68/EU on pressure equipment excludes only simple pressure vessels covered by this directive, it is then assessed against the PED's own 0,5 bar threshold, exclusions, fluid groups and category tables.

### What changes at 50 bar.L?

The product of the maximum working pressure PS in bar and the capacity V in litres is the line the directive draws. Vessels of 50 bar.L or less must be designed and manufactured in accordance with the sound engineering practice in one of the Member States; they fall outside Chapter 3, which by its own heading covers only vessels above 50 bar.L, so they need no EU-type examination, no notified body, no EU declaration of conformity and no CE marking, which Annex III point 1.1 reserves for vessels above 50 bar.L. The manufacturer must still ensure that the vessel bears the inscriptions laid down in point 1 of Annex III — in practice the point 1.2 particulars and, where a data plate is used, the point 1.3 rule that it cannot be reused and must leave a vacant space, since point 1.1 reserves the CE marking for vessels above 50 bar.L. Importers and distributors verify the narrower point 1.2 list, together with the type and serial or batch identification, the manufacturer's name and contact address and the Annex III point 2 instructions and safety information, before placing them on the market or making them available. Above 50 bar.L the Annex I essential safety requirements, the conformity assessment modules, the declaration and the CE marking all apply.

### Which conformity assessment modules does SPVD require, and do I need a notified body?

Every vessel above 50 bar.L must undergo EU-type examination (Module B) with a single notified body of the manufacturer's choice before manufacture. Where the vessel is built to harmonised standards the manufacturer chooses between design type, an assessment of the technical documentation and supporting evidence without a specimen, and production type, the same assessment plus examination of a prototype of the complete vessel; where the harmonised standards are not applied, or only partly, a prototype must be submitted for production-type examination. Before placing on the market a second module follows, set by the band: above 3 000 bar.L conformity to type based on internal production control plus supervised vessel testing (Module C1); above 200 bar.L up to 3 000 bar.L Module C1 or conformity to type based on internal production control plus supervised vessel checks at random intervals (Module C2), at the manufacturer's choice; above 50 bar.L up to 200 bar.L Module C1 or conformity to type based on internal production control (Module C), at the manufacturer's choice. Under Module C1 the notified body tests every vessel in each uniform batch of at most 3 000 vessels with a hydrostatic test, or a pneumatic test of equivalent effect accepted by the Member State, at 1,5 times the design pressure, and tests weld test-pieces. A notified body is also involved outside the modules: Annex I requires the approval of the welding processes and the qualification tests of the welders and operators to be carried out by notified bodies.

### What must be marked on the vessel and what must the instructions say?

Vessels above 50 bar.L bear the CE marking provided for in Annex II to Regulation (EC) No 765/2008 together with the last two digits of the year in which the marking was affixed, followed by the identification number of the notified body involved in the production control phase. Every vessel or its data plate bears at least the maximum working pressure PS in bar, the maximum working temperature Tmax in °C, the minimum working temperature Tmin in °C, the capacity V in L, the name, registered trade name or registered trade mark and address of the manufacturer, and the type and serial or batch identification; a data plate must be designed so that it cannot be reused and must include a vacant space for further information. The CE marking and the inscriptions are affixed visibly, legibly and indelibly to the vessel or its data plate, and the marking before the vessel is placed on the market. The instructions repeat those particulars except the serial or batch identification and add the intended use of the vessel and the maintenance and installation requirements for vessel safety; they must be clear, understandable and intelligible and in a language easily understood by end-users as determined by the Member State, and in Denmark the Danish order requires them in Danish.

### Who enforces SPVD in Denmark and what must be in Danish?

Executive order nr. 1304 of 23 November 2015 on the construction of simple pressure vessels makes the directive Danish law by reproducing it as annex 1, binds manufacturers, their representatives, importers, distributors, notified bodies and other duty holders, and requires the instructions under Annex III point 2 of the directive to be drawn up in Danish. Notified bodies must be legal persons established in Denmark, accredited by DANAK Den Danske Akkrediteringsfond for the task applied for and meeting Articles 21, 23, 29 to 31 and 33 of annex 1; complaints about their decisions go to the authority within 4 weeks. The product act lists the directive as product area nr. 7 and names Erhvervsstyrelsen as the control authority; Sikkerhedsstyrelsen has carried out the control of pressure equipment and simple pressure vessels since 1 December 2018 and is since January 2026 the department Markedsovervågning of Erhvervsstyrelsen, while the control authority's own guidance states that Arbejdstilsynet remains the market surveillance authority for pressure equipment made to order and for equipment imported from third countries for offshore oil and gas activities under the offshore safety act. From 30 May 2026 amending order nr. 492 of 28 May 2026 places the order under the product act, replaces Arbejdstilsynet by Erhvervsstyrelsen throughout, including the designation of notified bodies, adds the emergency procedures as § 6 a to § 6 c with crisis-relevant labelling in Danish or English, extends the fine provision accordingly and reissues the directive as amended as annex 1.

### What did Directive (EU) 2024/2749 change for simple pressure vessels?

Its Article 4 added two definitions to Article 2, crisis-relevant goods and internal market emergency mode, and inserted a Chapter 5a with Articles 38a to 38e. The measures apply only if the Commission has adopted an implementing act under Article 28 of Regulation (EU) 2024/2747 for vessels covered by the directive, only to vessels designated as crisis-relevant goods and only during an activated internal market emergency mode, with Article 38c(7) continuing to apply after the mode expires or is deactivated. Notified bodies then process applications for such vessels as a matter of priority without disproportionate extra costs for the manufacturers and make reasonable efforts to increase their testing capacity; a Member State may, on a duly justified request, authorise the placing on the market of specific vessels for which the notified-body procedures have not been carried out but compliance with all applicable essential safety requirements has been demonstrated as the authorisation prescribes, the Commission can extend the authorisation to the whole Union, the vessel must then bear the information that it is placed on the market as a crisis-relevant good, the manufacturer declares compliance on his sole responsibility, the authorisation sets traceability requirements, an end date not beyond the emergency mode and the measures to take when it ends, and the vessel bears neither the CE marking nor the Annex III point 1 inscriptions while Article 5 on free movement does not apply to it. The Commission may list standards or adopt common specifications giving a presumption of conformity for the duration of the mode, and market surveillance for the listed vessels is prioritised with mutual assistance between authorities. Member States apply their transposing measures from 30 May 2026.

## What changed

- 2026-09-13 (guidance): **Guide rebuilt on the SPEC-62 model from the consolidated text** — The guide was rewritten from the consolidated text of Directive 2014/29/EU of 30 May 2026, Directive (EU) 2024/2749, Regulation (EU) 2019/1020, the Danish executive orders nr. 1304/2015 and nr. 492/2026, the product act and the Sikkerhedsstyrelsen pages. The five cumulative Article 1(1) characteristics, the three Article 1(2) exclusions, the 50 bar.L line, the exact module routes for the 50 to 200, 200 to 3 000 and above 3 000 bar.L bands, the Annex I material, design, wall thickness and welding requirements, the Annex III inscriptions and instructions and the Chapter 5a emergency procedures replace the earlier summary, which left the numerical limits and the module routes unstated. Three statements in the old body are corrected: the scope is not limited to vessels whose exact limits must be looked up but is fixed by the Article 1(1) values given here; vessels of 50 bar.L or less are not a lower band of the conformity assessment regime but fall outside Chapter 3 altogether, following the sound engineering practice of a Member State; and the earlier statement that Sikkerhedsstyrelsen is the competent authority for simple pressure vessels is corrected to the current setup, Erhvervsstyrelsen as control authority through its department Markedsovervågning, with Arbejdstilsynet for vessels made to order and for offshore use. The Danish language requirement, which covers the instructions, is added, and the market surveillance reference is read as Regulation (EU) 2019/1020.
- 2026-05-30 (applies): **Emergency procedures apply; Danish executive order nr. 492/2026 in force** — Member States apply their measures transposing Directive (EU) 2024/2749 from 30 May 2026, so the Chapter 5a procedures for simple pressure vessels designated as crisis-relevant goods can be activated by the Commission during an internal market emergency mode. In Denmark executive order nr. 492 of 28 May 2026 places the simple pressure vessel order under the product act, replaces Arbejdstilsynet by Erhvervsstyrelsen throughout, deletes the reference to the director of Arbejdstilsynet in the designation of notified bodies, inserts § 6 a to § 6 c on the emergency procedures with Danish or English labelling, extends the fine provision to the language requirement and reissues the directive as amended as annex 1.
- 2024-11-28 (amendment): **Directive (EU) 2024/2749 enters into force** — The directive of 9 October 2024, published in OJ L on 8 November 2024, adds the definitions of crisis-relevant goods and internal market emergency mode to Article 2 and inserts Chapter 5a, Articles 38a to 38e, on the prioritisation of conformity assessment, national authorisations without notified-body procedures, presumption of conformity from listed standards or common specifications and prioritised market surveillance during an internal market emergency mode; transposition by 29 May 2026.
- 2021-07-16 (applies): **Regulation (EU) 2019/1020 replaces the market surveillance articles of Regulation (EC) No 765/2008** — Chapter III, Articles 15 to 29, of Regulation (EC) No 765/2008, which Article 34 and Article 35(1) of the directive cite, is deleted and the directive is listed as point 48 of Annex I to Regulation (EU) 2019/1020; its Article 18 takes over from the Article 21 of Regulation (EC) No 765/2008 on the procedural rights of economic operators, and its Article 4 requires an economic operator established in the Union for every simple pressure vessel placed on the market.
- 2018-12-01 (applies): **Sikkerhedsstyrelsen takes over the control of simple pressure vessels in Denmark** — From 1 December 2018 Sikkerhedsstyrelsen is responsible for the control of pressure equipment and simple pressure vessels; according to the control authority's own guidance Arbejdstilsynet keeps the responsibility for pressure equipment and pressure vessels made to order and for equipment imported for offshore oil and gas activities. For simple pressure vessels only the offshore leg can bite: Article 1(1) of the directive covers vessels manufactured in series, so a one-off vessel is outside it altogether. Since January 2026 Sikkerhedsstyrelsen is the department Markedsovervågning of Erhvervsstyrelsen.
- 2016-04-20 (applies): **Directive 2014/29/EU applies; Directive 2009/105/EC repealed** — Member States apply their transposing measures from 20 April 2016, Articles 1, 3, 4 and 5 and Annexes I and III apply from the same date and Directive 2009/105/EC, as amended by Regulation (EU) No 1025/2012, is repealed; vessels covered by the old directive, in conformity with it and placed on the market before that date may still be made available and put into service, and certificates issued by approved inspection bodies under it remain valid. Danish executive order nr. 1304 of 23 November 2015 enters into force the same day and repeals executive order nr. 684 of 10 June 2013, its designation provision having applied since 1 December 2015.
- 2014-10-28 (amendment): **Swedish-only corrigendum corrects the unit notation** — The one corrigendum to the directive, published in OJ L 307 of 28 October 2014, page 83, exists in the Swedish version only and replaces 'bar/liter' with 'barliter' throughout the Swedish text. It is purely terminological, changes no requirement and leaves no corrigendum mark in the English or the Danish text, so no language version of this guide needs to be built on a corrected text.
- 2014-04-18 (in-force): **Directive 2014/29/EU enters into force** — Adopted on 26 February 2014 as a recast of Directive 2009/105/EC aligned with the New Legislative Framework and published in OJ L 96 on 29 March 2014, the directive entered into force on the twentieth day after publication; Member States had until 19 April 2016 to transpose Article 2, Articles 6 to 41, Annex II and Annex IV.

## SPVD in plain terms

The Simple Pressure Vessels Directive (SPVD), formally Directive 2014/29/EU, is the EU's law for a deliberately narrow family of welded tanks. It applies to simple pressure vessels manufactured in series with five characteristics, all of which must be present at once: the vessels are welded, intended to be subjected to an internal gauge pressure greater than 0,5 bar and to contain air or nitrogen, and are not intended to be fired; the parts and assemblies contributing to the strength of the vessel under pressure are made either of non-alloy quality steel or of non-alloy aluminium or non-age hardening aluminium alloys; the vessel is built either as a cylindrical part of circular cross-section closed by outwardly dished or flat ends revolving around the same axis as the cylindrical part, or as two dished ends revolving around the same axis; the maximum working pressure does not exceed 30 bar and the product of that pressure and the capacity (PS times V) does not exceed 10 000 bar.L; and the minimum working temperature is no lower than minus 50 °C while the maximum working temperature is no higher than 300 °C for steel and 100 °C for aluminium or aluminium alloy vessels (Art. 1(1)). Only three groups are excluded: vessels specifically designed for nuclear use whose failure may cause an emission of radioactivity, vessels specifically intended for installation in or the propulsion of ships and aircraft, and fire extinguishers (Art. 1(2)). A vessel that meets the directive circulates freely, and Member States may not impede its being made available or put into service on their territory (Art. 5).

The 2014 text is a recast of Directive 2009/105/EC, itself the codification of Council Directive 87/404/EEC, aligned with the New Legislative Framework so that it carries the same economic operator duties, traceability rules and market surveillance procedures as the other CE marking directives (recitals 1 to 3). It entered into force on 18 April 2014, the transposing measures had to be adopted and published by 19 April 2016 and apply from 20 April 2016, when Articles 1, 3, 4 and 5 and Annexes I and III also took effect and Directive 2009/105/EC was repealed (Art. 42 to Art. 44). Directive (EU) 2024/2749 added Chapter 5a on emergency procedures, in force since 28 November 2024 and applied by the Member States from 30 May 2026 (Directive (EU) 2024/2749, Art. 4, Art. 11 and Art. 12). EUR-Lex records one corrigendum, of 28 October 2014, which leaves no mark in the English consolidated text.

## Scope

The first question is never how dangerous the vessel is but whether it matches the Article 1(1) description. Miss one characteristic and the directive does not apply: a vessel that is riveted or seamless rather than welded, that holds carbon dioxide or a refrigerant instead of air or nitrogen, that is intended to be fired, that is a one-off rather than series production, whose shell is alloy steel or an age-hardening aluminium alloy, whose shape is neither of the two Article 1(1)(c) forms, whose maximum working pressure exceeds 30 bar or whose PS times V exceeds 10 000 bar.L, or which works below minus 50 °C or above 300 °C for steel or 100 °C for aluminium, is not a simple pressure vessel. There is series manufacture when more than one vessel of the same type is made during a given period by a continuous manufacturing process, to a common design and using the same manufacturing processes, and vessels form part of the same family if they differ from the prototype only in diameter or in the length of the cylindrical portion within the limits set in Annex III (Annex III, points 3.1(f) and (h)).

Because Directive 2014/68/EU on pressure equipment excludes only simple pressure vessels covered by this directive, a vessel that falls outside the Article 1(1) description is not automatically outside CE marking altogether: it is assessed against the Pressure Equipment Directive's own 0,5 bar threshold, exclusions, fluid groups and category tables (Directive 2014/68/EU, Art. 1(2)(c)). The two directives are complementary rather than overlapping, and the same physical tank cannot be a simple pressure vessel and pressure equipment at the same time.

Inside the directive, Article 4 draws the second and more consequential line. Vessels of which the product of PS and V exceeds 50 bar.L must satisfy the essential safety requirements set out in Annex I; vessels of which that product is 50 bar.L or less must be designed and manufactured in accordance with the sound engineering practice in one of the Member States. The whole of Chapter 3, which carries the presumption of conformity, the conformity assessment procedures, the EU declaration of conformity and the CE marking rules, is headed "Conformity of vessels of which the product of PS x V exceeds 50 bar.L", and Annex III point 1.1 requires the CE marking only for those vessels. A 24-litre receiver at 10 bar is at 240 bar.L and inside the full regime; a 5-litre reservoir at 8 bar is at 40 bar.L and follows sound engineering practice with the Annex III inscriptions and instructions.

The duties fall on the economic operators: the manufacturer, the authorised representative, the importer and the distributor (Art. 2, point (7)). A manufacturer is whoever manufactures a vessel or has one designed or manufactured and markets it under his own name or trade mark (Art. 2, point (3)), and an importer or distributor that places a vessel on the market under its own name or trade mark, or modifies a vessel already on the market in a way that may affect compliance, is considered a manufacturer and takes on the Article 6 obligations (Art. 10). In Denmark, executive order nr. 1304 of 23 November 2015 makes the directive Danish law by reproducing it as annex 1 and binds manufacturers, their representatives, importers, distributors, notified bodies and other duty holders (executive order nr. 1304/2015, § 1 to § 4).

## What you must do

### Materials

Annex I starts with the material. The materials used for the pressurised parts must be capable of being welded, ductile and tough so that a rupture at the minimum working temperature does not give rise to fragmentation or brittle-type fracture, and not adversely affected by ageing, and they must be accompanied by an inspection slip drawn up by the producer of the materials, in which he certifies the results of the routine in-plant inspection test on products made by the same production process (Annex I, point 1.1; Annex III, point 3.1(i)). Non-alloy quality steels must in addition be non-effervescent and supplied after normalisation treatment or in an equivalent state, contain less than 0,25 % carbon and less than 0,05 % each of sulphur and phosphorus, have a maximum tensile strength below 580 N/mm2, meet the elongation values of Annex I point 1.1.1(c)(ii) parallel and perpendicular to the direction of rolling, and reach an average bending rupture energy KCV of at least 35 J/cm2 on three longitudinal test pieces at the minimum working temperature, with at most one figure below 35 J/cm2 and none below 25 J/cm2; that property is checked for steels used in vessels with a minimum working temperature below minus 10 °C and a wall thickness above 5 mm (Annex I, point 1.1.1). Non-alloy aluminium must contain at least 99,5 % aluminium and the alloys named in Article 1(1)(b) must display adequate resistance to intercrystalline corrosion at the maximum working temperature; both must be supplied annealed, with a maximum tensile strength of no more than 350 N/mm2 and elongation after fracture of at least 16 % parallel and 14 % perpendicular to the direction of rolling (Annex I, point 1.1.2). Welding materials must be appropriate to and compatible with the materials welded, accessories contributing to strength such as bolts and nuts must be of a point 1.1 material or another compatible steel or aluminium with an appropriate elongation and bending rupture energy at the minimum working temperature, and unpressurised parts must be compatible with the components they are welded to (Annex I, points 1.2 to 1.4).

### Design and wall thickness

When designing the vessel the manufacturer defines the use to which it will be put and selects the minimum working temperature Tmin, the maximum working temperature Tmax and the maximum working pressure PS; if a minimum working temperature above minus 10 °C is selected, the material qualities must still be satisfied at minus 10 °C (Annex I, point 2(a)). The inside of the vessel must be inspectable, the vessel must be drainable, the mechanical qualities must be maintained throughout the period of use and the vessel must be adequately protected against corrosion for its prescribed use (point 2(b)). Under the conditions of use envisaged the vessel must not be subjected to stresses likely to impair its safety, and the internal pressure must not permanently exceed the maximum working pressure PS, although it may momentarily do so by up to 10 % (point 2(c)). Circumferential and longitudinal seams are made with full penetration welds or welds of equivalent effectiveness, and convex ends other than hemispherical ones have a cylindrical edge (point 2(d)).

Wall thickness is set by one of two methods. Where PS times V is not more than 3 000 bar.L the manufacturer chooses between the calculation method and the experimental method; where PS times V is more than 3 000 bar.L, or where the maximum working temperature exceeds 100 °C, the calculation method is mandatory (Annex I, point 2.1). Under the calculation method the calculation pressure may not be lower than the selected PS and the permissible general membrane stress may not exceed the lower of 0,6 ReT and 0,3 Rm, using the minimum ReT and Rm values guaranteed by the producer of the material; where the cylindrical portion has one or more longitudinal welds made with a non-automatic welding process, the calculated thickness is multiplied by 1,15 (point 2.1.1). Under the experimental method the wall thickness must let the vessel resist, at ambient temperature, a pressure of at least five times the maximum working pressure with a permanent circumferential deformation factor of no more than 1 % (point 2.1.2). Whichever method is used, the actual wall thickness of the cylindrical section and the ends may not be less than 2 mm for steel vessels and 3 mm for aluminium or aluminium alloy vessels (point 2.1).

### Manufacturing and welding

Preparation of the component parts, for example forming and chamfering, must not give rise to surface defects or cracks or to changes in the mechanical characteristics likely to be detrimental to the safety of the vessels (Annex I, point 3.1). The characteristics of welds on pressurised parts and of the adjacent zones must be similar to those of the welded materials and free of any surface or internal defect detrimental to safety; welds must be performed by qualified welders or operators possessing the appropriate level of competence, in accordance with approved welding processes, and the approval and qualification tests are carried out by notified bodies. During manufacture the manufacturer must ensure consistent weld quality by conducting appropriate tests using adequate procedures, and those tests are the subject of a report (Annex I, point 3.2). This is the one place where a notified body is involved even before the conformity assessment modules begin.

### Harmonised standards and presumption of conformity

Vessels above 50 bar.L that conform to harmonised standards, or parts of them, whose references have been published in the Official Journal are presumed to conform to the essential safety requirements those standards cover (Art. 12). The references are published by Commission communication, most recently in OJ C 326 of 14 September 2018, and cover the welder and welding procedure qualification standards and the steel delivery standard for simple pressure vessels; the Commission also hosts the SPVD Guidelines, which represent the unanimous opinion of the Working Group Pressure and are not legally binding but help ensure that the directive is applied consistently, and the list of notified bodies in the NANDO database (European Commission, simple pressure vessels pages). Using harmonised standards is not compulsory, but the choice has a procedural consequence: a vessel built to them may be type-examined on the documentation alone, while a vessel built outside them must be submitted as a prototype (Art. 13(1)).

### Conformity assessment: Module B plus C1, C2 or C

For vessels above 50 bar.L the assessment comes in two stages. Prior to manufacture the vessel is subject to EU-type examination (Module B) by a single notified body of the manufacturer's choice. Where the vessel is manufactured in accordance with the harmonised standards the manufacturer chooses between design type, an assessment of the adequacy of the technical design through examination of the technical documentation and supporting evidence without examination of a specimen, and production type, the same assessment plus examination of a prototype representative of the production envisaged of the complete vessel. Where the vessel is not manufactured, or only partly manufactured, in accordance with the harmonised standards, the manufacturer must submit a prototype for production-type examination (Art. 13(1)). The Annex II point 1.3 application carries a written declaration that the same application has not been lodged with another notified body and the technical documentation with an adequate analysis and assessment of the risks, a general description, conceptual design and manufacturing drawings and schemes with the explanations needed to understand them, the list of harmonised standards applied in full or in part or the descriptions of the solutions adopted instead, design calculations and examination results, test reports, the Annex III point 2 instructions and a document describing the materials, welding processes and checks selected and any pertinent design details, plus the supporting evidence; where a prototype is examined the documentation also contains the welding qualification certificates, the material inspection slip and a report on the examinations and tests performed. The notified body draws up an evaluation report, issues an EU-type examination certificate where the type meets the directive, keeps itself apprised of changes in the generally acknowledged state of the art, and must be informed of every modification to the approved type, which requires an addition to the certificate; the manufacturer keeps a copy of the certificate, its annexes and additions with the technical documentation at the disposal of the national authorities for 10 years (Annex II, points 1.3 to 1.9).

Prior to placing on the market the second module follows, and the band decides it. Where PS times V exceeds 3 000 bar.L the vessel goes through conformity to type based on internal production control plus supervised vessel testing (Module C1). Where it does not exceed 3 000 bar.L but exceeds 200 bar.L the manufacturer chooses between Module C1 and conformity to type based on internal production control plus supervised vessel checks at random intervals (Module C2). Where it does not exceed 200 bar.L but exceeds 50 bar.L the manufacturer chooses between Module C1 and conformity to type based on internal production control (Module C) (Art. 13(2)). Under Module C1 the manufacturer presents the vessels in uniform batches of at most 3 000 vessels of the model of the same type, and the notified body performs a hydrostatic test, or a pneumatic test of equivalent effect where the Member State has accepted the test safety procedures, on each vessel at a pressure Ph equal to 1,5 times the design pressure, and carries out tests on test-pieces taken from a representative production test-piece or from a vessel to examine weld quality on the longitudinal welds, repeated on the circumferential welds where the weld technique differs; for vessels designed by the experimental method those test-piece tests are replaced by a hydrostatic test on five vessels taken at random from each batch. The body affixes or has the manufacturer affix its identification number to each vessel of an accepted batch and draws up a written certificate of conformity, and if a batch is rejected it takes appropriate measures to prevent that batch reaching the market (Annex II, points 2.3 and 2.4; Annex III, point 3.1(g)). Under Module C2 the body checks random samples at random intervals and verifies that the manufacturer really tests every vessel at 1,5 times the design pressure through staff independent of production personnel (Annex II, point 3.3). Under Module C the notified body that issued the EU-type examination certificate examines the manufacturing description, the inspection document and the undertaking to test every vessel before manufacture begins (Annex II, point 4.2). Records and correspondence relating to the procedures are drawn up in an official language of the Member State in which the notified body is established or in a language it accepts (Art. 13(3)).

### Declaration, CE marking, inscriptions and instructions

The EU declaration of conformity states that fulfilment of the Annex I essential safety requirements has been demonstrated, follows the Annex IV model, contains the elements specified in the relevant modules, is continuously updated, is translated into the language or languages required by the Member State where the vessel is placed or made available and, where more than one Union act requires a declaration, is drawn up as a single declaration identifying all of them; by drawing it up the manufacturer assumes responsibility for the compliance of the vessel (Art. 14). The CE marking follows the general principles of Article 30 of Regulation (EC) No 765/2008, is affixed visibly, legibly and indelibly to the vessel or to its data plate before the vessel is placed on the market, and is followed by the identification number of the notified body involved in the production control phase, affixed by the body itself or under its instructions; the marking and the number may be followed by any other mark indicating a special risk or use (Art. 15 and Art. 16). Vessels above 50 bar.L bear the CE marking together with the last two digits of the year in which it was affixed (Annex III, point 1.1).

Beyond the CE marking, the vessel or its data plate bears at least the maximum working pressure PS in bar, the maximum working temperature Tmax in °C, the minimum working temperature Tmin in °C, the capacity V in L, the name, registered trade name or registered trade mark and the address of the manufacturer, and the type and serial or batch identification of the vessel; where a data plate is used it must be designed so that it cannot be reused and must include a vacant space to allow other information to be added (Annex III, points 1.2 and 1.3). The vessel is accompanied by instructions drawn up by the manufacturer containing those particulars except the serial or batch identification, the intended use of the vessel and the maintenance and installation requirements for vessel safety (Annex I, point 4; Annex III, point 2), in a language which can be easily understood by end-users as determined by the Member State concerned, and the instructions, the safety information and any labelling must be clear, understandable and intelligible (Art. 6(7)). In Denmark a vessel may be placed on the market or made available only if the instructions under Annex III point 2 of the directive are drawn up in Danish (executive order nr. 1304/2015, § 5).

### Obligations by role

Manufacturers design and build vessels above 50 bar.L to Annex I and vessels at or below that value to sound engineering practice, draw up the technical documentation and run the Article 13 procedure, draw up the declaration and affix the CE marking and the inscriptions, keep the documentation and declaration for 10 years, keep procedures in place for series production to remain in conformity, sample-test and keep a complaints register where the risks warrant it, apply the type and serial or batch identification and their name and contact address, supply the instructions in the required language, take corrective action, inform the authorities of risks and cooperate on request (Art. 6). Authorised representatives act under a written mandate that must at least allow them to keep the documents for 10 years, answer reasoned requests and cooperate with the authorities, and cannot take over the design or documentation duties (Art. 7). Importers place only compliant vessels on the market, verify the manufacturer's procedure, documentation, CE marking, inscriptions and identification for vessels above 50 bar.L and the sound engineering practice, Annex III point 1.2 inscriptions and identification for vessels at or below it, add their own name and contact address, ensure the instructions, protect vessels above 50 bar.L in storage and transport, sample-test where warranted, take corrective action and keep the declaration for 10 years (Art. 8). Distributors act with due care, verify the marking, documents, instructions and identification before making a vessel available, protect it in storage and transport and see that corrective action is taken (Art. 9). Importers and distributors that sell under their own brand or modify a vessel become manufacturers (Art. 10), and every operator identifies its suppliers and customers for 10 years (Art. 11). Since 16 July 2021, Regulation (EU) 2019/1020 also requires an economic operator established in the Union, a manufacturer, importer, authorised representative or fulfilment service provider, for every simple pressure vessel placed on the market (Regulation (EU) 2019/1020, Art. 4).

### Emergency procedures since 2026

Directive (EU) 2024/2749 inserted Chapter 5a. Its measures apply only if the Commission has adopted an implementing act under Article 28 of Regulation (EU) 2024/2747 for vessels covered by the directive, only to vessels designated as crisis-relevant goods and only during an activated internal market emergency mode, with Article 38c(7) continuing to apply after the mode expires or is deactivated (Art. 38a). Notified bodies then make best efforts to process applications for such vessels as a matter of priority, whether lodged before or after the activation, without disproportionate additional costs for the manufacturers, and make reasonable efforts to increase their testing capacity (Art. 38b). A Member State may, on a duly justified request from an economic operator, authorise the placing on the market on its territory of specific vessels for which the notified-body procedures have not been carried out but for which compliance with all applicable essential safety requirements has been demonstrated in accordance with the procedures set out in the authorisation; the Commission may extend the authorisation to the whole Union by implementing act, and the vessel must then bear the information that it is placed on the market as a crisis-relevant good in a language consumers and other end-users easily understand. The manufacturer declares on his sole responsibility that the vessels comply with all applicable essential safety requirements, the authorisation sets out the procedures used, any specific traceability requirements, an end date that cannot go beyond the emergency mode, any continuous conformity assessment requirements and the measures to take when the mode ends, and the vessel bears neither the CE marking nor the Annex III point 1 inscriptions while Article 5 on free movement does not apply to it (Art. 38c). The Commission may list appropriate standards or establish common specifications giving a presumption of conformity for the duration of the mode, and vessels placed on the market on that basis stay deemed compliant afterwards unless there is sufficient reason to believe they present a risk (Art. 38d); market surveillance for the listed vessels is prioritised, coordinated through the Union Product Compliance Network, with mutual assistance between authorities (Art. 38e). In Denmark Erhvervsstyrelsen issues the authorisations, informs the Commission and the other Member States immediately, notifies the Commission where it considers a listed standard or common specification insufficient, and prioritises market surveillance and assistance; the information and labelling must be in Danish or English (executive order nr. 492/2026, § 1, nr. 5).

## Enforcement and penalties

Article 34 applies Article 15(3) and Articles 16 to 29 of Regulation (EC) No 765/2008 to the vessels covered by Article 1; those articles were deleted by Regulation (EU) 2019/1020 from 16 July 2021, which lists the directive as point 48 of its Annex I, so the reference is read as that regulation, and the Article 21 of Regulation (EC) No 765/2008 that Article 35(1) cites corresponds to Article 18 of the new regulation on the procedural rights of economic operators. Where a market surveillance authority has sufficient reason to believe that a vessel presents a risk to the health or safety of persons, or to domestic animals or property, it evaluates the vessel against all the requirements of the directive, requires the economic operator without delay to take corrective action, to withdraw the vessel or to recall it within a reasonable period commensurate with the nature of the risk, informs the relevant notified body and, where the operator fails to act, takes provisional measures prohibiting or restricting the making available, withdrawing or recalling the vessel and informs the Commission and the other Member States; a provisional measure against which neither a Member State nor the Commission objects within three months is deemed justified (Art. 35). Disputed measures go to the Union safeguard procedure, in which the Commission decides by implementing act whether the national measure is justified (Art. 36), a compliant vessel that nevertheless presents a risk is handled the same way (Art. 37), and formal non-compliance must be ended: a CE marking affixed in violation of Article 16 or of Article 30 of Regulation (EC) No 765/2008 or not affixed at all, a notified body number wrongly affixed or missing, missing or wrongly affixed Annex III point 1 inscriptions, an EU declaration of conformity not drawn up or not drawn up correctly, technical documentation that is unavailable or incomplete, absent, false or incomplete manufacturer or importer information, or any other unmet administrative requirement of Article 6 or Article 8, and where the non-compliance persists the Member State restricts or prohibits the making available or ensures that the vessel is recalled or withdrawn (Art. 38).

Penalties are set nationally: Member States lay down effective, proportionate and dissuasive penalties for infringements by economic operators of their transposing laws, which may include criminal penalties for serious infringements (Art. 40). In Denmark, executive order nr. 1304 of 23 November 2015 punishes with a fine, unless a higher penalty is due under the act on the construction of certain products (lov nr. 155 of 20 February 2013) or other legislation — a subsidiarity clause the 2026 amending order left untouched, although the order itself now rests on the product act — breaches of its § 4 and § 5 and of the provisions of the directive reproduced in its annex 1, and failure to comply with decisions, orders and prohibitions issued under the order, with corporate liability under chapter 5 of the criminal code (executive order nr. 1304/2015, § 9); from 30 May 2026 the order rests on the product act and the fine also covers the requirement in § 6 a, stk. 3, that crisis-relevant information and labelling be in Danish or English (executive order nr. 492/2026, § 1, nr. 2 and nr. 6). The product act (lov om produkter og markedsovervågning) lists the directive in section 2 as product area nr. 7, names Erhvervsstyrelsen as the control authority and provides orders to warn users, stop misleading marketing, remedy, stop sales or supply, withdraw the product effectively and immediately, recall it from users or destroy it, warnings, prohibitions on placing on the market, making available, supplying or taking into use, orders to stop sales and to remove a wrongly affixed CE marking. 7. A breach of the executive order's own rules carries a fine only: the act would have allowed the order to set imprisonment for this product area, and the order does not (LBK nr. 22/2026, § 2, § 9, § 14, § 15, § 16 and § 37). Sikkerhedsstyrelsen has carried out the control of pressure equipment and simple pressure vessels since 1 December 2018 and is since January 2026 the department Markedsovervågning of Erhvervsstyrelsen, while the control authority's own guidance states that Arbejdstilsynet remains the market surveillance authority for pressure equipment made to order and for equipment imported from third countries for offshore oil and gas activities under the offshore safety act. In practice only the offshore leg can bite here (Sikkerhedsstyrelsen, rules and control pages; Erhvervsstyrelsen, Sikkerhedsstyrelsen page).

## How Conphora helps

Conphora monitors the Simple Pressure Vessels Directive, its harmonised standards, the SPVD Guidelines and the Danish executive orders, and maps your vessels against the five Article 1(1) characteristics, the three Article 1(2) exclusions, the 50 bar.L line and the module bands, flagging gaps in the technical documentation, the EU-type examination certificate, the EU declaration of conformity, the CE marking and notified body number, the Annex III inscriptions and the instructions before they become enforcement problems. The platform helps you build and keep the documentation and the 10-year records, combines the SPVD declaration with the machinery, ATEX, EMC, Low Voltage and other declarations the same product needs, and alerts you when a standard, a Danish executive order, an emergency-mode activation or the enforcement setup changes.
