The toolkit is an order to bring the equipment into conformity, restriction or prohibition of placing on the market or putting into service, withdrawal from the market, notification of the Commission and the other Member States, the corrective and restrictive powers of Regulation (EU) 2019/1020, and national penalties, which in Denmark are fines rising to imprisonment of up to 2 years.",

    "text": "The directive obliges Member States to ensure that only conforming equipment bearing the CE marking and the guaranteed sound power level and accompanied by the EC declaration of conformity is placed on the market or put into service, to make the manufacturer or its authorised representative bring non-compliant equipment into conformity, and, where the Article 12 limit values are exceeded or non-compliance continues, to restrict or prohibit the placing on the market or putting into service or ensure withdrawal from the market, informing the Commission and the other Member States; every restrictive measure must state its reasons and the legal remedies. During an internal market emergency the surveillance authorities may take all corrective and restrictive actions under Regulation (EU) 2019/1020, which since 16 July 2021 also supplies the general powers to demand documents and supply-chain information, buy and test samples, require corrective action, prohibit the making available and have equipment withdrawn, recalled or destroyed. The directive contains no penalty article of its own; penalties are set by national law. In Denmark, executive order nr. 506 of 14 May 2025 lets Miljøstyrelsen prohibit the marketing of a bilag 2 machine that exceeds the limits, prohibit marketing after a notification from another Member State, and prohibit the continued use of a bilag 2 machine put into service without being marketed; unless a higher penalty is due under other legislation, it punishes with a fine the marketing or putting into service of a machine in breach of §§ 3 to 7 or § 9, a notified body's failure to report that it no longer meets the criteria, breach of a prohibition, and failure to hand over documents, supply-chain information or website ownership details or to change or remove online content, with the penalty rising to imprisonment of up to 2 years where the breach is intentional or grossly negligent and has harmed or endangered the environment or sought an economic advantage; companies can be held liable under chapter 5 of the criminal code.",

Breaches of the marketing, marking, declaration and limit rules and of these orders are punished with a fine, rising to imprisonment of up to 2 years for intentional or grossly negligent breaches that harm the environment or seek an economic advantage. The directive is not listed in the Danish product act, so the general product-surveillance powers come through this order.",
